I'm not so sure about being conditioned Poppy - that's disregarding the DFS nonsense btw
The best bargains I've ever had, have all been misprices posted on this site. (I missed this one anyway, and after the e-buyer fiasco with their cheap tellies - I'd probably have given it a miss anyway).
But to anyone who tried - good on 'em I say

On cancellation of my order I wrote to Argos to ask why they had a policy of taking peoples money before they knew whether they could satisfy orders. They replied saying that as per their T&C's there was a misprice and they would not be supplying the TV. I then replied asking if they could answer my question and that I was not expecting a TV for 49p - but seeing as they were so keen on highlighting their T&C's also why they did not contact me as per their T&C's before cancelling the order. Just got this reply which has not enhanced my view of Argos one bit :

Thank you for contacting us regarding the e-mail dated 02/08/05 that you received from Argos. I am sorry that you disagree with our position on this issue.
However, in accordance with the terms and conditions referred to in the e-mail and that appear on our website, I can confirm that we will not be selling the product in question (Bush TV/DVD combi (Product No: 536/1108)) at the price of £0.49.
All orders placed at this price have now been rejected, and we are in the process of fully refunding.
On behalf of Argos, may I apologise for any inconvenience that this may have caused. We now consider this matter closed and we will be unable to engage in any further dialogue.

I got a same email in fact they told me as far as they are concerned the matter is closed. It isn't until I get my money back. I only asked why they didnt offer the TV but good old HomebArse and ArgoS!IT seem to pick and choose what terms and conditions suits them.0

I did not order anything however I am fed up of Argos getting away with things like this. :mad:
I have ordered on two other occasions. Once I even did a reserve and collect at the store. Yea they had the goods but not at the price they advertised on the web site. It was the attitude that got me. I took the time and trouble to print the order out and go and collect the item. It was ordered in good faith but at half price. It was in stock, however it was an pricing error and not only did they refuse to honour the order but did not even offer an apology for me having to fetch it as if it was my fault. I complained and got just the standard letter in the end along the lines of it being an error etc.
However when they said they can offer me the goods at another competitive price (but not half price just £5 off or something) it feels like something to con you into their stores. Yes trading standards were interested but it was just not worth the time and effort to get all the evidence together and anyway the manager refused point blank to sign my order to say they were refusing to let me purchase the goods I ordered.
I just shop elsewhere now.:j0 -

If it's unfair contract terms you're going on about, only the consumer can enforce the legislation re their contract in the civil courts. From my limited experience of mispricing, I'd think if Trading Standards were interested, it might just be that you had a good point, and it is worth the time and effort sometimes.0 -
This Argos/Homebase thing has gone on a bit now so what do we do? Shut up and forget about it or take it further and get our rights made clear once and for all? Well, like others say it was obviously a price mistake but its the way its been handled and how long after they found the mistake that they have been taking peoples money.
As stated before i rang my legal helpline and have now received a claim form which i have to fill in and return. Thats the main reason im posting to get the best points across in the claim form.
I have to tick that its for 'buying goods or services'. I also have to send copies of any relevant info so i will send the letter i received yesterday and also print out a copy of the email received also. I will also print out a bank statement showing when the money came out.
It states on the claim form 'please state in date order an account of events leading up to this claim. PLease supply names and addresses of people who witnessed any incident or could provide helpful evidence.
What main points would you say i need to get across other than the fact that they have taken money after they found out about the price mistake? Any ideas i will note down to help. If you would be willing to be contacted (if need be) then please PM me so i can have details to put down.

That's very interesting, I have had that email too, after being given a second email that was clearly a blanket response that you must have had too.
Like you I asked why money had been taken after they had told me the order was cancelled, and asked why they hadn't fulfilled there terms in offering the tv at it's correct price.:rudolf:0 -

I agree. Mispricing is an offence that if they are repeatedly offending they should be brought to task on it.:rudolf:0 -
Does anyone remember the gamecube fiasco a small while back? I ordered one of those from Virgin and eventually they said if I could buy it from somewhere else, they would refund the difference, they had already taken my money then aswell. How is this any different??0
