I don't see that your cases will be affected. The test case is specifically related to current account overdraft charges; your accounts are not current accounts and the charges aren't overdraft charges.0

Hi everyone, just a quickie to let you all know that I had my day in court today. Clydesdale (or rather Barclays!) didnt show up and I won!!!! So they have to pay me by the 15th of this month:j
PJ1967 I would definately keep at them, they were adament to me that I would not get anything back from them so i started with my claim, then they refunded half so I took them to court for the rest and have won today. I just tweaked the template letter here and there so it was relevant to my situation.

I'm on incapacity benefit and took a college course for PC and network engineering, a course that you study from home. This course was financed by CFS, i pay £65 per month over 30 months and because my benefit payments were disrupted by the department of works and pension and my giro was late i missed one of my payments. I have paid 29 of the 30 months, but my £65 arrears has now jumped to nearly £500 arrears because of these letters saying i'm being charged £22.50. the courses cost £1,950 and i have paid £1,885
yet CFS have told the college to stop my tuition.
So therefore i am £1,885 out of pocket and my college course has been stopped.....so in effect i have paid CFS £1,885 and i have nothing to show for it...as i can't study to get my qualifications.....
Any advice would be much appreciated.

I am having a few difficulties with my finances at the moment and I only have myself to blame.
I am currently doing all that i can to resolve this situation and have entered into a debt recovery plan with my creditors.
All of my creditors have accepted this plan and i am grateful for that, with the exeption of Clydesdale financial service (recently changed to Barclays Partner Finance).
They have now levvied charges against my account which I am unhappy at because the charges are greater than the monthly payment i'm expected to make to the account.
They are charging me £75 per month......yes per month!.. in charges.
Whenever i speak to Barclays they tell me that i cannot claim to have the charges removed. They wont explain why but just tell me to seek advise, which is what i'm doing now.
I admit that its my fault i cant afford the original agreed payments, and i dont mind incurring charges because of it. What i object to is £75 per month when my payments are only £24!!!!
Are these charges above board or are they trying to get me to submit and just accept them without question?
I have requested that they send a full account statement and plan to use the template letters on this site to claim the charges be removed from my account. Is this allowed as its strictly a loan and not a bank account?
Also, as they are going to charge me £75 per month wether i pay what i can afford or not, can i just not pay them anything until this matter is resolved?
I am doing all i can to pay off my debt, i'm working 2 jobs which works out at around 65 hours a week over 7 days. I cannot do anymore but this is just crippling all of my efforts.
Can somebody please help.

First, welcome to the site. If you haven't found your way to the Debt Free Wannabe board yet, I suggest you visit. There are a number of helpful and experienced heads on the board that can help you snip your outgoings even further and squeeze a bit more out of any income.

With regard to your charges, I guess from your message, it is a Barclays loan we are talking about here. It seems they refuse to accept your DMP and are now charging you more than the monthly payment amount.
You really need to find out what these charges are for. Barclays are obliged to tell you, why you have been charged. Do the charges have names or any kind of description? Have you missed any payments or been late with the monthly amount agreed?
How have you approached them so far? It's probably best to write and send the letter registered post, requesting details of your charges as in the Reclaim guide. This way, you can see exactly how much you've been charged and work out whether any charges can be reclaimed.0 -

Thanks for the reply.
Just to clear things up. I have allready been in the DMP for 6 months. All of my creditors accepted this plan and the payments that i offered. I did use Payplan to help set this up but they only provided the figures and template letters to send off. I was over the moon when all of my creditors wrote confirming that they would accept it.
6 months later and i get the letter from Barclays finance saying that i am on arrears and have incurred £25 charge due to this.
They gave me seven days to payup. I phone them and they told me that the DMP was only of a limited time of 6 months and that i needed to resubmit my income/expenditure.
Whilst i was doing this (obvoiusly this took about 3 days as i was waiting for my other creditors to give me account balances in order for me to give accurate figures) i got a call from Barclays asking why i hadnt paid yet.
I went through it all again and i got told that so for i have incurred £75 of charges over an 8 day period due to lack of payment. I queried the charges and was told be a very rude chap to "just seek advice", and then he hung up the phone!!!!
My payments under the original DMP were still going through, i have a standing order set on the 25th of each month to pay all my creditors which has never been late or missed.
I am still waiting for my account statements to show the charges so i dont know exaclty what the full description is until then.
They should now have the income/expenditure sheet and hopefully this will be resolved, but if they are going to continue to charge me then i'll never pay this debt off!
When i receive confirmation from them with regards to the new DMP payments, and when they send out the account statements i will post again with fuller details.
I'm trying sooo hard to get this paid off, and i'm going out of my mind thinkng that regardless of how hard i try its never going to happen.
Thanks to you guys on this site though there maybe a little light at the end of the tunnel.....although it is a fair way off yet.

Argh, Im really hoping to get my charges back from Clydesdale.
I got my statements back from them today which amount to over £1000. I'm hoping they pay out at least 3/4!0 -

I just rung them up to discuss this and have been told, because they are not a bank i won't be seeing a penny and further charges are going to be put onto my account.
Is this true? I know that it's a finance agreement and not a bank but £22.50 each time is stupid, i even told them i will be taking legal preceedings and they are happy to see me in court and he laughed about me getting information on this website.

He won' be laughing for long. They are not covered by the test case so it is an advantage to you that they are not a bank because the case will not be put on hold. Send them a prelim letter & ask for it back.0

I just spoke to the debt collectors as the case has been passed to them now, for the sum of -
£1300 ish.
It was a buy now, pay in 9 months time finance agreement.
I bought a laptop for £581.58, which i didn't clear in the 9 months so i was paying £26.60 over 39 months with interest of £455.82 at 29.9%APR
The debt collectors now want £1300 in full or £220 a month. Neither of which i can do, as i have other debts etc... scattered about which i am trying to sort.
Where do i stand? I can afford £26.60 a month, but i missed payments since November for some reason, and they are not willing to help me.
