    You guys must have learned from these misprices by now that all you will get for ordering is the inconvienience of sorting out the problems.

    The days of retailers honouring misprices are over.

    Exactly. The Ts&Cs do not override the Law of Contract. A contract is formed when offer, acceptance and consideration have taken place. If they take your money (and by that, I mean actually debit your card), the contract has been formed. Their condition stating that a contract has not been formed until despatch is worthless and wouldn't stand up in court. I won't be taking them to court, though, as I really can't see them taking the money. If they do take the money, I might start arguing with them, as it's about time online retailers stopped trying to hide behind unfair terms and conditions to cover their incompetence.

    They could try to argue mistake (as per their terms and conditions), but this "mistake" is now over 12 hours old and although Argos has altered its website, it has not rectified the Homebase website, thus allowing people to continue to order. They've had plenty of time to sort this out, and have shown that they were about to do something about it because they altered the Argos site. As you've already stated, there's no need to take the money upon receipt of order. Most reputable retailers take payment upon despatch. You can't have it both ways - if you take the money upon receipt of order, then that's when the contract was formed.

    MyUserNamesTaken - People are saying that their debit cards have been debited though. This is what wrankles with me. I can't tell on my order as I used a credit card... and as it is only £5 odd it doesn't really matter. But if it was for a large amount it would as it could mean I couldn't order an alternative from elsewhere if Argos (or whoever) had used up my credit limit.

    just phone your credit card company and they will tell you if the money has been taken

    Chances are that the money has been reserved, rather than actually taken. It will take a few days for the money to actually leave your account. You'll be able to see it, though, as it will show up as a withdrawal, and any subsequent refund will also show up. Reserving the money doesn't constitute consideration. Annoying, I know, but that's how it goes.
