    No chance of the tv (thinking ebuyer) however vouchers are a possibility although still unlikely as they must have received so many orders! I really hope they get into trouble over this though as its becoming common with them:rolleyes: Oh well they will have a huge mess to sort out but it serves um right.

    Disagree with you on that one... Feel sorry for the red-faced programmer who let that one slip through the net! Wonder if they'll own up to it?

    It doesn't really matter whether they've taken the money or not. Their T&Cs say:
    2.3 Acceptance of your order and the completion of the contract between you and us will take place on despatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it
    4.1 We take payment from your card at the time we receive your order, once we have checked your card details and stock availability.
    So just because they've taken payment because they've RECEIVED your order doesn't mean they've accepted it! And the contract isn't bound until they dispatch it.
    You don't get medals for sitting in the trenches.

    Agree with you in a way I guess but they should learn from previous mistakes. How is it other online retailers manage to avoid these mistakes? They need to think to themselves why it is happening and put a stop to it, if others can they can.

    I do not expect Argos to provide 1000's of TV's at £5 but to me (as mentioned previously) it doesn't matter what they write in the T&C's, it is the law that counts. I wouldn't think it was up to a supplier to define when the contract is intialised. My gut instinct (and sense of fairness) is that Argos (or any supplier) should not take any money at all until they are willing to provide the goods they offer. I have a friend who operates a website and this is the way they operate - no funds processed until goods are about to be dispatched.

    Whether the law defines when a contract is undertaken or not I do not know but I am not happy that any supplier takes money if they are not willing to undertake their 'invitation to treat'.

    But what a treat it would have been! :-)

    I'm know I'm being lazy but... having read through the first 13 pages I can't see it anywhere. I've just tried the code and... 'Sorry this item cannot be found'
    So I'm guessing they've discovered the error.
    (Apologies if someone else has put on a similar entry on the next 12 pages)!

    But their T&Cs make it quite clear that this is what you agree to when you buy from them. I for one won't be bothering to fight this in the courts if I don't get my telly.
