This one won't go away until she is about 21 :rolleyes: but the main point here is that it is YOUR computer, YOU pay for the electricity and YOU are the adult. Therefore, what you say goes.
I was a nightmare teenager, and know whereof I speak, but ultimately YOU are in control. Tell her she can have use of the computer as and when YOU allow her. It is a privilege, not a right. (And privileges can be stopped if behaviour is unacceptable.)
Also, talk to your OH and explain to him that the teenage years are difficult and you both need to work together and back each other up on discipline otherwise the child will always play you off against each other.
I'm not a parent but hops this helps in some way?

I wouldn't worry too much about getting sued, correct me if you can find a case that shows otherwise but AFAIK people only get sued for sharing files, not downloading (it is illegal but it isn't punished at the mo AFAIK - they've realized if they can scare everyone into not sharing people won't be able to download hehe).
Anyway, check which sites she's using and check whether you have a program called Kazaa installed, also look for Limewire Shareaza and WinMX (these are less popular but also have illegal files on their networks).
There's others but she's unlikely to use them.
If she is using illegal sites, I'd recommend you get her an account on www.allofmp3.com (there's a button for English in the corner, and here's a thread discussing it: HERE).

I am very sorry to hear that using MSE is causing family strige. Might I suggest a computer time sharing system, whereby you agree when each will use the computer and give fair undisturbed time for doing so.
Perhaps splitting the evenings down the middle and having two hours each.

The only time kids and parents agree about anything is when the kids leave home imo
