    Common sense doesn't come into it-this is employment law we are talking about :)
    Anyone who sacks a woman knowing she is pregnant is leaving themselves wide open to an unfair dismissal suit on the grounds of sexual discrimination. It may not be right or fair but it is the way it works under current legislation.

    Interesting thread, any news yet?

    Some great advice on smp at other benefits you may be entitled too.

    The way I read vaio's posts was if a person lies or withholds information during an interview then the employer can dissmiss that person. Nobody would really want someone working for them, with them, if they tell a big porkies.

    Its easy you sack them for something else being pregnant isn't an excuse to not do your job properly.

    It depends what you do for a job. There are some things I wouldn't be able to do if I were pregnant ~ is that good enough reason to get the sack? :confused:

    But how would you know:confused: I'm presuming you can't actually ask "are you pregnant" at interview, since that question would have to be asked to men also.:D

    and how could you sack someone for withholding that they are pregnant cos as mentioned by law you don't have to say you are pregnant till x week.

    OP- what about temporary work to get MA.

    Sorry spendless, I thought someone said earlier in the thread to lie about 'a pregnancy' to get smp. Your right though, an employer wouldn't know.

    I work for a small business. If there were certain things I couldn't do, I'd just take the load from others which I could do, then they would do the things I couldn't do.

    There's no problem in that at all and certainly no reason to be sacked.

    It's the same as if you have been off work sick, but can go back to work, only there are some things you still can't do. The company can't sack you for it at all.

    Would you care to mention which bit(s) of our legal pack are funny? It has lots of reference to the applicable law so if you point out the bits you think are wrong I can point you towards the legislation
