Taking a stand against estate agents do u agree?

    With regards to the rubbish etc, there will probably be something in the lease about rubbish being left in communal areas and that will ultimately be the responsibilty of the owners of the other flats , this clause should be transfered through to any tenancy agreements and it is therefore up to the relevant land lords to chase their tenants up on this.
    Your landlord is responsible for the gas safety check on your property and it is a legal requirement that this is carried out annually, there is no such thing for the elctrics at this point in time but they must be of a safe standard.

    The maintenance and cleaning of communal areas will usually fall to the freeholder through their managemnet company, but as dolcevita says if the owners haven't been paying their managemnet fees then this may slip.

    None of this will be the LA's responsibility directly but you have done the right thing going through them as they are the LL's agent.

    hoovering is the only cleaning that should be needed for inside communal area...unfortunately....

    just before I moved some new young people moved in - in the few weeks there were there, the building lock got broken, someone was sick in the stairwell. In my corridor (their flat is in my corridor), there was a can of beer left, then a piece of sandwich, smelly bin bag for days :confused:

    Ask managing agents for
    1. a copy of their complaints procedure
    2. a list of the professional bodies they belong to
    3. any Ombudsman service relevant to the management of the block
    4. the address of the local public health department.

    Chappers is absolutely right - gas appliances must checked and certificated as safe on an annual basis by someone who is CORGI registered. Your LL/LA should have arranged this and all LAs/ LLs need to retain a copy of each annual Gas Safety Certificate for at least 2 years, as well as providing the Tenant with a copy. Failure to comply with gas safety regs is a criminal offence - the LL can be cautioned, prosecuted, fined or be given a prison sentence, depending on the circumstances.

    Has the LA/LL ever done a property inspection in the past 4 years?

    Does the LA do the lettings for the other flats?

    Jemma - you said that you had phoned and the LA was coming out to have a look.

    I personally would move from any property where a LL/LA fails to comply with something as basic as a gas safety check - they need to comply with that one ASAP, preferably with a hard "kick" from the HSE. If you are hoping to get things improved and stay there then when the LA has been, write a letter to the office, confirming what course of action is agreed, if anything - keep it polite & just stick to the facts (it is hard not to get emotional about these things). Say something along the lines of "Thank you for coming out to the property , after my phone call of ....(date). The issues that we discussed were (a)... (b).... (c) (and so on). It was agreed that ................. and .................... by .......................(date)...........

    Pu in it that they are breaking the law by not having gas checks done, and you want one done within the next 24 hours.Remind them that you have been a good tenant, as neilp said.

    Keep a copy of the letter for yourself and either send the letter Rec Delivery or take it to the Agent by hand. When you have problems with a LA/Ll never just do it by phone or in person - you need to have a dated record of events.

    The last property inspection we had was in 2004 from then on i havent seen anything, the lady on the phone did say about the gas safety certificates they had but i have nt seen anyone here to check that, the lady on the phone did say that they might of come in when i was nt here, but dont you need notice before they enter the property???? never seen any notices or certificates. the last check they did on my boiler was back in 2004 i recall.

    Ok have some updated news i have just seen a man by the gate in the small patio garden we have with this property this gate leads in to the communal garden all i heard was this can be sealed and then there was banging and that was it. Wonder what it meant ? are the polish people locking me out ? lol

    All of the five flats we have here are run by the same estate agents, thanks for all this advice its been great to have some support i am typing a letter now.

    Your landlord shouldn't entr or allow anyone to entre without your permission and a copy of the GSC should be left with you.

    I wouldn't go jumping to any conclusions about the garden yet.Wait for a response from the LA

    The landlord holds the whip not the agent.

    Perhaps the LL wants to safeguard his profit so he wont want expenses.

    i was just reading the contract and the landlord should give me 24 hours notice to inspect except in an emergancy to enter the property.
