So Worried -What Can I Do?

Honey, I have just read all this thread, and one thing I notice is the good advice that has been repeatedly given is being ignored. I know you are stressed and it must be very difficult in your pregnant state to cope with this horrendous situation and I really feel for you :grouphug: but you must listen to the advice being given to benefit from all our different experiences which we all have to offer here on MSE.
Lets look at the facts once again....
If you let the baliff in, he will have legal right of entry for the foreseeable future. You will grant him permission to break into your home if you are out and legally remove what little posessions you have left. These posessions are worth pennies in the form of payment towards your debt. Pointless! You would be left still in debt, with no TV, nor Computer and you will no longer feel safe and happy in your home.
You have legal rights to protect you in these situations. Use your rights! Stop asking 'if you should let him in' everyone has told you so many times NOT TO LET HIM IN and you shouldn't. Do not answer the door, switch off the ringer on your phone and deal in writing only with the council once he has reported back to them that he cannot gain entry. He has no right to break & enter. He could be arrested and charged. Therefore, DO NOT LET HIM IN. It is simple!
Wait to be contacted by the courts or the council direct. Stop making calls to him appealing to his better nature - he hasn't got one, that's why he does the job he does. He would not be an experienced baliff if he was swayed by compassionate feelings.
So do this :
Ignore the Door
Ignore the Phone
Do not waste money calling him again, waste of time!
Take care of your health and your unborn baby immediately by stopping all this stress that will make you ill.
Let the legal system take it's course, the courts will take over the case and the baliff will GO AWAY!
If you are threatened or intimidated in any way, call the Police! The baliff would be arrested if he tries to break in or bothers you in any way.
Just listen to all the good advice hon, it is given by all on here with good intention to help you. Ignore it at your peril as they say. The poster who implied this is not being nasty, just wants you to ignore the baliff and stay safe and keep well.
Good Luck,
Ember xx~What you send out comes back to thee thricefold!~~0 -
I will be ignoring the phone and door today- as advised, I just thought it might be best to let him do his thing, but given your advice I obviously shouldn't trust him.
I may see if a friend will pick me up and spend the day at her house just so I don't have to stress about it.Membre Of Teh Misspleing Culb0 -

Good, thank you for your post, I am now reassured you are going to be okay (was worried after reading this thread last night) and I think it may be a good idea to stay with your friend for the day to get a rest from the stress and get some emotional support too.
Trust me honey, everything will be okay. At the end of the day, the council tax debt will pass back to the county council and the baliff will go away. If you need further help do not hesitate to PM me. Remember my advice, if when you are outside your property and you are bothered by anyone, call the Police and report the baliff. Take care of yourself and try to find a smile, it will all be okay in the end. Stay strong for you and your new baby.
!!!!{hugs}}}

Does anyone have an idea of how many times he will call round before passing it back to the council?
Is there a procedure or is it just up to him to decide when to give up?Membre Of Teh Misspleing Culb0 -
"It may be possible to get the bailiff withdrawn if there are Special Circumstances. The debtor should contact:
the creditor if they have a County Court Judgement;
or the Council if they owe Council Tax or Community Charge;
or the Magistrates Court if they owe a fine;
and inform them of any Special Circumstances, ask for the bailiff not to be used, and if it is possible to make a new payment arrangement.
Special Circumstances are usually defined as:
Serious illness, mental impairment, learning difficulties, physical disability, long term sickness, unemployment, recent bereavement, severe financial difficulties."
I just found this on a site and am wondering if i should give the council another try, and really stress my situation. I would imagine as I am unemployed and quite ill I would fall into this category.
Maybe I'll get a more sympathetic person on the phone this time.Membre Of Teh Misspleing Culb0 -
Morning starlite
You were up very early!
I think its a great idea to get away for the day, go and have a nice relaxing time.
What time did your partner get home last night? (Sounds like his company are making his life pretty stressfulpoor chap )
I dont think he will be constantly calling every day, he will have far too much other stuff to deal with. But i think untill the debt is cleared you should make sure you know who you are opening the door too.
How are you feeling today?xxx

Hello..i'm okay today..in quite a lot of pain but a lot more relaxed than yesterday!..i will be calling the council as soon as they open and try to work something out again, and if that fails i'll be off out for the day and forgetting about it!
Bf got home at 10.30..not great! Can't wait til he gets a proper contract and his hours will become a bit more regular..and shorter!Membre Of Teh Misspleing Culb0 -
Thats such a long day for him!
Yeah give them a ring, stress how bad this is making you feel and that there really is nothing you can do about it.
I hope the pain eases as the day goes on, can you take painkillers when you are pregnant? Just curious! Maybe a warm bath would be better.
He needs 9 to 5 job doesnt he!:starmod: :staradmin :starmod:I gave up jogging for my health when my thighs kept rubbing together and setting fire to my knickers:starmod: :staradmin :starmod:0 -

Hi starlite
Only just seen this thread. I'm with the others DON'T OPEN THE DOOR. You sound as though you're going to leave yourselves short by the amount you were offering to pay back, and if you fail, then what? You're going to loose the few things you have that you're currently trying to protect.
Check out the 'entitled to' website given to you. Maybe you can use the money that you'll receive once baby is born for moving.0
