Toshiba have a dead pixel policy and unfortunately with just one dead pixel that means your machine is within manufacturer specification - http://support.toshiba-tro.de/kb0/TSB5400ZD0002R01.htm
Displays are classified under ISO 13406-2, which specifies the maximum permissable number of defective pixels per million - http://en.wikipedia.org/wiki/ISO_13406-2 You may want to check if the Toshiba is a Class I or Class II display. If it is the former, which is unlikely for a low cost laptop, then no stuck-on pixels are permitted.
Lesson for the future - buy items like this online, in which case you get to return the laptop under the 7 day distance selling cooling off period rules, or buy from a store with a guaranteed any-reason returns policy such as Costco.0 -

Update:
Well went back and they won't Exchange it or refund or give Gift Voucher as apparantly pressing the power button ON means it a used item now. Even though I turned it straight back off.
They did ring Toshiba who told them they will let them know on Monday as they need to fax some paper work.
So they have kept the laptop and I should be getting a phone call from the store on Monday to let me know if Toshiba agree to the exchange or whatever.
I also rang Comet Customer Services who logged a complaint and rang the store to ask if they were willing to give me gift vouchers but the store manager refused and it seems he was the one of the rude staff in the store, looked like a kid to me.
PS. The customer service lady did put me on hold and come back and tell me it was 4 dead pixels or more per sq 1inch i think.0 -

Excellent find, Mines got 2 Dead pixels, Its a WXGA and its 2 Dead black ones. I actually reserved it online to collect via click and collect on comet online store. Does this count?
Funny thing is I could of got is around £15 cheaper online delivered free and was actually going to order it online but there was a 5-7 day deliver time and i wanted it quicker.:(0 -

I don't think that counts, I remember looking into that before when someone else asked.
But as I recall that was PC World, check the Comet site for T&C.
Can I ask, when you turned the laptop on what happened?
Did it go through an install procedure?
Or did it start windows, if so it was already used.
Look for file dates of when it was first used, they should all be today if not they have tried it on.
Take you receipt and buy the cheapest waranty then take it back. (Just a thought)0 -

You have no rights. There are standards for LCDs and two dead pixels is well within an acceptable tolerance.
ISO-13406-2 is the one. Your's will have been a Class 2 which is standard consumer and means it can have 2 pixels per million either lit or not or 5 sub pixels per million lit or not. As you can see, yours falls within that so you can't claim as it's technically not defective.
Class 1 monitors are military/medical spec.
You'll get no joy from Tranding Standards either because they'll tell you exactly the same.0 -

It's an interesting one, in that some manufacturers (particularly of budget LCD monitors) state in their literature that the screen may have a small number of dead or stuck pixels.
However, they don't have a chance - unless the staff at Comet pointed out the faults (or likelihood of faults) to you before you bought. The dead pixels are clearly defects, and given that you took it straight back it's obvious that the defects were present from new. Hence warranty is irrelevant - it should just be a case of replacement or refund.
I would take it back, calmly explain this to them and then tell them that you will pursue it via legal action if they do not co-operate.
