In response to Brummy bloke, you state that Igloo committed fraud, if you had any real legal training (and I have) you would be aware that nothing is a criminal offence until convicted by a Court! The store manger / security person could be liable for false imprisonment - a common problem for staff as they can only detain if an offence has been committed, this is a sticky area because as i say bove an offence is only deemed as being committed once a conviction has been obtained. For common assault Igloo only had to have a fear of immediate and unlawful physical violence, to then lay a finger on her would be to add battery. Im also surprised that none of the legal personnel have pointed out that trespass is not purely a civil matter, it is now also capable of being a criminal offence. And this is as per Halsburys.

As for Igloo: I would whoop their a*ses up and down the aisles!!! I had a run in with Tesco trying to fob me off once, none of the managers seemed to have a clue about Sale of Goods Act etc, I always wonder whether this was substandard staff or just an act.
:D I understand ALOT more than I care to let on :D

Do we know where Igloo shops as I believe the trespass laws are very different here in Scotland.

Sorry - too busy eating Birds Eye Roast Beef to get much more involved!
Personally I wouldn't expect ANYTHING from the Police - this is a grey area with little chance of conviction, so they will ignore this and go back to catching speeding motorists.
If it were me I'd pin my hopes on:
    a. Letter to the Chairman pointing out what a fantastic customer I was for Tesco (11,000 Clubcard points shows a hell of a lot of loyalty)
    b. Letter to Chairman pointing out that my children's school massively collects Tesco computer for schools vouchers, but won't any more because my kids are scared to go there and by the way I'm Chair of Governors and Secretary for the PTA ;)
    c. Letter to my local paper (in a town with six (6) Tescos - and I'm not kidding there are six) explaining how upset I was with them compared to other stores (just when the local Council are considering allowing another supermarket in the town)
    d. Letter to Watchdog slagging off Tesco for being less than customer friendly
    e. Messrs Sue, Grabbit & Run Solicitors threatening civil action and demanding compensation.
    Go for it.
You don't get medals for sitting in the trenches.

    Hi Igloo,

So sorry to hear about the way you have been treated. This could have been a large majority of us at MSE that could have been in your situation. Do keep us informed and let us know what the outcome is, particulary to see how Head office responds.

    We're all thinking about you!

Just to throw a hypothesis at some of the legally-minded people on this thread:

When you scan vouchers on the self-service tills, it asks you to post the voucher in a slot. This slot has some kind of device to tell if it's been posted or not. Can it tell if you've posted a voucher or just a piece of cardboard from a cereal packet?
If you post a piece of paper/card instead of the voucher you scanned, are you comitting fraud?

I'm not suggesting anyone does this, I'm just curious as to the legal status of these vouchers, as they're not a cash equivalent.

Igloo, you have my sympathies. I've had a similar situation when my umbrella set off a shop alarm and a manager stopped me in the street by putting his hand on my shoulder. I hope that you have the satisfaction of knowing that you're generating a whole bunch of negative publicity for Tescos.

    Good luck!

well you cant decieve a machine in the eyes of the law, you can however commit theft from automated machine. i am guessing as im not really a fan of tesco, it would depend on what their own policy on doing this to their machines is, they may have a condition of use where they can persue the perpetrator ( civil proceedings).

  • I nearly always use coupons and also use the self-service checkouts.

Oh my God! I've seen them check what coupons people have put in!

If igloo got into trouble for using genuine coupons just IMAGINE what trouble you'd be in if you just put cardboard or paper in!
And anyway....when you use the self service ones...you scan the coupon and then put it in the slot. What are you saying, you scan 10 coupons and put in 10 pieces of cardboard instead? That is just downright dishonesty and you'd have to be a magician with the slight of hand!
  • Hi Igloo,
I have been sat here for the best part of an hour, reading this thread, and I am absolutely gobsmacked that you have been treated so disgracefully, and in front of your young children.
The advice other MSE'ers have provided is excellent, and along the same lines as what I would suggest, I just wanted to add my support, send a hug to you and your little ones, and wish you all the best in a speedy resolution xx

Give the brain dead twonks what for!! :D
if you cant have what you want, be grateful for what you have :T
