bankruptcy help needed

    HI Ihave received a county court form from one of our unsecured creditors. What do I do? As you know we are moving shortly and then when we have fees for BR we will file for it. My I and E shows I have nothing left to pay creditors. I am working my income on the fact that in two months my salary will stop and I will go onto incapacity benefit which is about £72.00 per week, although for the next two months I will recieve half pay which is fees for our BR. Do I fil this form in or put on it going BR. Sorry if I sound a bit dense but not sure.
    Scarlett I post my I and E any help would be appreciated. This is from when we move into rented on 26th march no mortgage SL or debts included

    hi Diane,

    if you are going to go for the BR then personelly i would just ignore the form as this would usually take a while for them to sort anything out against you..After which time you will be either BR or have court arranged etc.

    Check with your advisors on tuesday ref this but i was advised to ignore all these by mine until court for BR..even if they threaten severe consequences etc...what can be more severe than BR??

    A ccj etc would be wiped off by the BR so no need to worry bout that. All unsecured debts would be either wiped completly or as part of the IPA which looking through the I & E posted wouldnt apply as you need to have £100 surplus income free after all monthly expenses so wouldnt apply...if your accounts are correct you have less than £5 spare so ignore, ignore, ignore....

  • How about hairdressing, dental, perscripstions, and contact lenses etc?
    We are a family of 4 and were allowed £90 for clothing..........
    Not sure if union subs will be allowed?
    Also you could try putting a holiday fund of £40 on as some are not allowed for repairs and christmas.........:confused:

    not very good at this, but Im sure someone will be able to tell you more soon :)

    You're welcome Diane...Yep if they dont know where you are until BR then why worry? after the BR the OR deals with them and as far as im aware doesnt give new address as all the creditors dealings must be direct with him/her.

    SW32...The SOA form does ask something about do you pay official membership in a union, or something like that...im a Veterinary nurse and we have to pay yearly subsription to practice and therefore work so i would claim for that.

    the more you put on the SOA the better, as the OR can always say to take it off but they would NEVER add to your figures!

    Give it a try...they can only say NO.

    My hubby is a staff nurse so he has to pay union and (forgot this one )registration fees so it is a necessary. To add to all this strife we are going through my hubbies unit has just been taken over by a private consortium and his work load has technologically advanced so he is not sure he will be able to do it anymore, but we will see. As empty wallet quotes life is like a game of snakes and ladders you get to the top only to end up at the bottom again. read it its good. we have always been on the bottom up until two years ago when we decided to get a mortgage,back to top of ladder. We have always had financial difficulties due to my ill health, been through the death of our baby daughter and loss of jobs. So two years ago we get house my ill health returned whilst on holiday last october then within months we are now on the bottom of ladder again. No worries the only way is up!!!!

    Diane...so sorry to hear about your baby daughter, that must have been the worst time ever....puts everyones money worries into context.

    Hi tigerfeet Thank you for your advice The phone is listed twice as we do have mobile but also we pay land line through a different company than call charges. We dont have breakdown cover. The food one I will have to fight as my allergies do not allow for certain foods and costs are often higher because of my diet.I didnt even think of putting holiday fund down but I will now. When I come to fill my forms in I will consult the list and do a little adjustment. Will keep posting no doubt will have more questions

    Glad to be of some help. It doesn't matter if your outgoings are more than your incomings. Then if things like food are cut you can balance that out with your clothes allowance or holiday allowance.. If asked you can just say that you are taking steps to reduce your outgoings, several posters have done this.
