Then I would say prison was not so unlikely
I disagree, last conviction for theft was ten years ago. That coupled with a guilty pleas and any half decent solicitor would keep him out of prison. Prisons are bursting at the seams. I would say it was highly unlikely he would go to prison.0 -

I think Kenneth came back in the last couple of days - it appears he is struggling to pay his sons debts and the credit card companies are now threatening all sorts.
Its such a tricky one, as I really do not believe he should go to the police especially if there is a possibility of prison, but the son should take some of the pressure and stress of sorting the debts out.

I have read this thread very carefully.
The one thing that comes back to me is that the son will do something like this again at some future date. To me this is a certainty.
I have an opinion as to whether he should be 'shopped' but this will not help OP.

Yes your son could go to prison - fraud does carry a custodial penalty, however, it does not mean that a Judge would send him to prison - It would depend on any previous convictions and also what could be put forward by way of mitigation.
From all that I have read from you I would say that you should def report your son to the police - He is 28 now and has clearly never learnt from previous mistakes (you said he has prev for fraud + theft when in teens).
You have given your son chances in past to prove himself and this is how he has repaid you. If he were a man he would report himself in any event - YOU should not in any way feel guilty for doing this - you brought this person into the world and if he can do this to his own farther who's to say how far he would go in the future. TIME TO FACE FACTS - Your son is scum - time for you to parent again and turn his life around by making him a MAN.0 -
Time for some tough love Kenneth. Report the fraud to the police. You can still support your son during the court process, but you and your wife shouldn't suffer financially for his crime.0

Yes I am still reading.
I am not struggling to pay the debts my Son is.
He knows fine well I will not pay.
This week I called the CC companies involved and told them the truth.
To my amazement they were not at all bothered.
They infact encouraged me not to go to the Police.
Basically they simply want there money back!
A&L told me if I went to the police I would also get into trouble! How I really don't know. I think this was there usual scar tactics
My Son can afford £170 a month accross the 2 cards which both CC companies are refusing.
I am currently thinking about getting the Police envolved however I think this would tip my Wife over the edge.
I have an appointment with CCCS on thursday hopefully this will be productive.
Apparently I could offer to pay the CC companies the £170 between them and then agree to sell my Fathers house once he has passed,t o pay the debt fully. A charging order I think they called it.
My Son is actually telling me to go to the Police as I think he is getting increasingly worked up about the mess. He told me the other day he would rather go to Prison than have any more crap from me. Well that is they way he put it.0 -
I'm not surprised the CC companies are worried. It is unlikely that a court would award the full compensation.0
