    I do know all that, nevertheless a very good explanation.

    As the OP has assets, I suggested he needs to be careful as creditors are more likely to take action that where the debtor has no assets i.e. "a man of straw". Similarly where a debtor has assets the courts usually take the view that he can and ought to pay more than someone in dire financial straights.

    That situation is a long way off and hopefully creditors will agree that £180 / month is a reasonable repayment plan, given the OPs circumstances, however they do not have to. Every day of the week many unfortunate people end up in court for failure to pay unsecured debts.

  • As of yet still no word from the two cc companies envolved.

    I've been doing a lot of thinking since my original post.
    The first credit card I knew about didnt have my Son as a 2nd card holder. I transfered the balance for him onto a lower rater card.
    When in Spain he has made himself a second card holder and then ran up a bill.
    The other card was obtained with my details and again ran up.

    He has never missed a payment on these and my credit report confirms this.
    Also my credit report shows that he took out a Next Directory in my name and another cc! He has however paid and closed these accounts now.

    What would happen to my Son if I contacted the 2 companies and told them the truth?
    My Son has told me he wants to pay them back but he can't afford to at the rate they are requesting.
    Would prison be a posibility? He has a lot to lose a good job and a child.

    Yup, he's a good kid alright, with a lot to lose. That's why he committed fraud and ran up a bill of thousands of pounds in your name which he knew he'd never be legally bound to pay back.

    I would have disowned him by now. It wasn't just careless, it was wilful, deliberate fraud.

    Unlikely, think others have posted that it's not likely.

    Why don't you just call the card companies and tell them that YOU are struggling to pay these and that you need to enter into a special arrangement to repay the balance?

    It'll affect your credit file but you previously said that future credit wasn't an issue and that you believe that your son will make payments to you.

  • can't your son get a second job maybe at night if he works in the day. im sure this would teach him never to do it again. and get the debts paid off quicker.

    someone i know has just found out that their daughter has got three ccards all maxed out and things on hp. she hasn't even got a job.

    he is now making her get two jobs to pay him back.

  • He already works a lot of hours.
    He's not a kid he is 28. Its not possible for him to work any more hours due to childcare.

    The A & L have today refused the payment.
    When I called they said circumstances hadnt changed so they are not willing to accept a payment plan.

    They have said if I continue to pay £70 I will eventually goto a debt collection company.
    I really dont know what to do.

    To be absolutely honest Kenneth the best thing you could do is tell the police, tell the credit card company and tell your son to wake up and smell the coffee.

    I know you think you'd be harming him but you wouldn't, in fact, you'd be doing him and more importantly, yourself a BIG favour.

    He wouldn't go to prison but he would get a wakeup call that may save the rest of his life. In addition, you would be free of the burden and stress and from that point the healing will begin. Believe me! Set yourself free and take out the dirty washing!!!

    You'll feel so much better once you do.

    I've already spoken to a Solicitor over the phone and there is no guarantee that he wont go to Prison.
    My Wife will have a nervous break down if I go to the Police.
    I honestly don't know what to do. I am not willing to Pay his debt and I am not in a position to get further loans to help him.

    I don't know whether to call the CC companies and tell them the truth.
