Seller sends empty envelope- WHAT TO DO NEXT?

Hi
Was it a jiffy or blue mailer? If the envelope was a jiffy it will show whether there has ever been a bottle in it surely - is that so? What does the 'stamp' look like can you scan it for us as there are various ways to buy postage and some mean that the item was in the envelope at the PO. This will help to know if the seller was at fault or the PO.
You as the buyer hold a lot of cards, don't worry.0 -
I was going to ask the same as the others about the postage label. Is the label one from the post Office - this would be square and cannot be taken from the package without being ripped (It is segmented - if that makes sense) so this cannot have been defrauded. If it has been printed via Paypal or SmartStamp then she can choose herself what options she uses.
If it is a standard label then it is by all account possible to 'defraud' a buyer in this way by just sticking the envelope with the 'correct' postage into any postbox and not taking the slip to the PO. I do it all the time - not defrauding of course, but if I do not have time to get to the Post Office then I will often send something RD and pop it in a postbox and take that chance, if anything happens then it would be my loss but as I sell low value items I take this chance rather than keep my customer waiting. Our local PO does not let me use it for sending RD by pre-paid methods beleive it or not so this is why i take the chance. This is how I know itcan be done and why it would not be checked!
I think at the end of the day, she is going to accuse you of whatever but you do not have your goods and she is not being helpful. It is time to start the item not as described via eBay and a dispute Paypal. You don't have your goods, it was the sellers choice to send a £70 item via a method that was not fully insured and she should have offered Special Delivery only - as the sellers this was her risk, not yours really and she should have insisted that you have it send SD or cover the additional cost herself (this is what I would have done for a high value item to ensure it is insured). If she thinks you are lying then so be it, you will just have to deal with that and ignore it and don't get into a row about it, there is nothing to prove you were, or were not, lying, but keep the packaging anyhow in case the RM do want to see it (unlikely but just to be on the safe side). I've had customers do the same to me and I replace or refund. You will never know if someone is lying I am afraid to say so just deal with whatever she throws at you but get your money back and make sure in the future that if you pay this sort of money for something you insist on it being sent Special Delivery and pay the extra.
PS. I think this smells fishy to me to be honest, a big seller would know it is up to her to replace if it does not arrive - it has arrived and she thinks if it has gone missing in the mail it is 'your fault'. Sadly, not so, the onus still falls onto the sender of the goods to claim for them being missing! I will stick my neck out here and say she never sent it in that envelope IF the label is the print at home sort. why lose £2.54 in postage though? I would suggest you go to her selling history and see if she has since sold/or is selling the item you bought and then you will have your answer!! She may have made a 2nd chance offer and decided to fob you off!0 -

If the seller is a scammer, and has half a brain, they'll know that not sending the correct postage sticker will mean they're caught out from the start.
You cannot plead ignorance if a 34p stamp was sent on it.It's BOUGHT (to Buy), not BROUGHT (to bring) AND you cannot be frauded, only DEfrauded.
Please do not buy animals from a pet store. Visit your local sanctuary or centre and give a good home to an unloved or abandoned animal.0 -
Hi guys- thanks for replying
I have phoned up the post office the seller sent the item from- they say item has been weighed and stickered 1st class 2.54 so I am assuming the item was in the envelope however it is still hard to beleive as the envelope was perfectly sealed- no tears- no rips and no sign of damage-
The seller has positive feedback of almost 2000 and it is 100% positive- Should I claim with paypal or Lost claims with Royal mail? If I claim with paypal the seller will still deny not sending item, basically she will be accusing me, and I will be blaming her, what are the chances of me winning the paypal dispute ?
Or will an easier option will be Royal mail lost claims where I will get less than half of my money back?0 -

Its a jiffy bag. Im going to take photos of the envelope/stamp tonight and post them up on here- however she did give me the contact details of the post office she sent it from...0 -
RM will refund £34, but no more.0

I would email the seller with the above that FloFlo has suggested in post 30.
If the seller refuses to refund, then I'd start a Paypal dispute, not sure if you'd win, but paypal do tend to side with the buyer..
Besides, RM claims have to be started by the Seller Not the buyer.I Hate Jobsworths!!!0 -
forget chasing RM.
your contracts with the seller.
im surprised the PO even confirmed that to you over the phone.
in as much that they would even remember the item in question0 -
In my experience Paypal always sides with the buyer!! I had someone send stuff back with chewing gum on and they gave the buyer their money back!!If the seller refuses to refund, then I'd start a Paypal dispute, not sure if you'd win, but paypal do tend to side with the buyer..

OP, you have not specified whether this was sent via the Post Office or has a standard stickered label on it.
PO details mean nothing really unless she has sent you the RD slip so you can see it in front of you. I can fake those if I need to to scan to someone!! It is up to her to claim, if there is a loss then it is her fault for not covering it with the adequate insurance.0
