Hi All,
Well over the last 4 years i have halfed my debt from £25k to about £12.5k.
Two credit card companies Cahoot and Halifax no longer want to help me after being on an arranged DMP with them.
Cahoot decided to sell my just over £4k debt to Robinson, Way & Company Limited if anyone has heard of them before telling me.
And Halifax which i have been having a battle with for the last 4 months stopped accepting my DMP and turned my balance of £4k debt into now nearly £5k as they keep on slapping on charges and interest which im not happy about as im now incurring debt even further.
Halifax tell me that my debt will be passed onto their sister HBOS company Blair Oliver & Scott in the next 2 months.
Would it be worth me sending CCA requests to them both as im now being hounded by them both and im no longer accepting their phone calls.
But im still paying an arranged DMP amount to Halifax but have not sent any payments to Robinson Way at the moment, only a letter stating that i can not pay what they request on the dates they wanted it last month but have not heard anything from them since.
If i do send CCA requests to them i will update you all but just wanted to ask here first if im replying in the right place.

There is no reason you can not request a CCA . If its not provided stop playing , hassle over !:T0

Ok time to see if everyone in the CCA class is paying atention so time for a surprise test (and an update in a roundabout way)

Creditor sent CCA which they replied they had no agreemant and correctly said they could not persue the debt through court, but would continue persuing the debt which is incorrect

If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

no this is the concise answer:pSo what they are basicaly saying is, they, a company that has no right holding my data in the first place, are going to asign an agreemant that doesnt exist to 'a' company, but cant make up there minds who yet, (though i doubt Moorcroft would be daft enough to buy it:p ............on second thoughts yes they would:rolleyes: ) which would mean passing that data that they have no right to have in the first place to a third party which they have no right to pass it to and are going to asign all the rights of something that doesnt exist to whoever they choose which means one of the lucky sods above will recieve my data that they have no legal right to have.
Which breaks just about every rule and just for good measure they ask you to call an 0870 number which is in breach of the OFT guidelines namelyCommunication
2.1 It is unfair to communicate, in whatever form, with consumers in an unclear,
inaccurate or misleading manner.
2.2 Examples of unfair practices are as follows:
h. asking or instructing debtors to make contact on premium rate
telephone numbers
