Loramos/lfts - I've also received various random paperwork - including a forest worth of credit card statements that I could have looked at online! I'm using a rule of thumb that if the documents they sent will show the court that they are legally entitled to collect the debt then I will co-operate with them. Statements etc prove nothing. What I want is a document showing that the DCA has been assigned the debt for collection by the OC. However, since the majority of DCA purchase the bad debts of banks and credit card companies for peanuts I'm fairly confident that no such document exists.
The DCAs will try and confuse you and bully you but don't let them - stick to your guns and don't pay them a penny until you have proof that they are entitled to.0 -

Thanks louisa79. Do i write back to ARC asking for a clear and true copy of the cca plus copy of letter of assigment . Do i also ask them why they are continuing to take the standing order when the account is in dispute?0

No need to get involved in any other correspondence - that is exactly what they would like you to do - as it diverts your attention away from their legal obligations.
Simply behave as though they have sent you nothing, for the time being, and send the 12+2 day letter.
Once you have sent the 12+2 day letter, you have, in effect, put ARC 'in default' - you should stop any payments at that stage.I am NOT, nor do I profess to be, a Qualified Debt Adviser. Hi rog2 I sent the 12+2 on 19th Aug they sent me a bad copy cca etc on a letter dated 19th Aug but recieved on23rd. I have not sent them any other letters but they took a £1 payment from my bank on the 28th0

I would just like to add that, if you look at the following link, you will find details of what a consumer credit agreement should contain - and only rarely do 'application forms' constitutute a full consumer credit agreement.
Check what you have been sent against the check list - I doubt that it contains the required information.
There is, also, a template letter on the link - you might, if you feel it is appropriate, like to send ARC a copy.

hi , quick update from me , i received a letter from kays saying they are not pursuing the debt , the account has been closed but will remain as unsatisfied on their credit files ..
