I've only made one request re an alleged Barclaycard debt via 3 dca's that have at some point bought the debt (and 2 sets of dca solicitors - different names but shared the same address and had office space with RMA) and all they have ever produced were illegible copies of short form application forms.
The latest dca is Thames and they have sent me statements and an unsigned copy of the deed of assignement but have exceeded all time limits so I've written again to the OFT and Trading Standards.0 -
Just wanted to commend BAB for the use of the word 'vexatious'. Absolutely fantastic. BTW - 12+2+30 is up for me and AIC on 27th. Can't wait for the postman tomorrow!!!! Stapeley I think I love you and I hate those moronic firetruckers at AIC....THE LONG AND THE SLOW ROAD SEEM TO APPLY TO DEBTS AND DIETS... THE TWO THINGS I WANT TO SEE THE BACK OF...:D0

As i said in my post i cant take the credit for that georgiasmum, its a template from the consumer action group forum.
But using it in a letter to a large bank who think they could ignore my CCA request got them, or should i say there solicitors, of my back..........for nowThats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….0 -

I have a complaint to the FOS over Sainsburys inability to provide with me the CCA for my credit card account. They did send a scanned image of something but it would not appear to contain the prescribed terms and conditions.
I wrote to the Office of Fair Trading to complain and they sent a letter outlining that they believe Sainsburys are acting unlawfully in relation to my account. I have forwarded this across to the FOS and asked them to obtain a true copy of the CCA for my account.
I've just had the 4 weekly update from the FOS and it still waiting to be passed to an adjudicator.Almost debt-free, but certainly even with the Banks!0 -
I do not believe FOS will make a judgement on if a CCA is enforceable . They will request that the company act correctly , that is , if they do not supply a CCA , stop threats and harassment etc. Please keep us informed on what response you get .0

I wouldn't depend on the FOS to resolve your complaint in a way that you're happy with. My partner asked the FOS to obtain a CCA from Capital One last September. The complaint is still ongoing almost a year later :mad: . The FOS have now confirmed that Cap One can't provide the CCA, but we've also been told it isn't FOS policy to penalise companies for failing to comply with the law:rolleyes: .
So at the end of the day it looks as if our complaint has been a complete waste of time and effort.
I sincerely hope that you have better luck with the FOS.0 -

Morning everyone.A long update I'm afraid will try to be brief.Have sent a number of CCA requests(05/08/08) Follwed up letter 19/08/08.One reply stating asking client to comply AND one dated 19/08/08 recieved 23/08/08 from ARC acting for EGG.They have sent a blurred Egg card agreement dated 28th december 200. Consist of two pages first page refers to Credit Agreement regulated by CCa act 1974. para 3 states "we will let you know from time to time approved limit we have set.page two appears to have my signature dated 02/01/2002.This was an online application so not sure how I signed this.Arc also sent pages 02 -46 of card activity dates from14/02/2005 til02/07/08.They have not sent copy of assignment letter.I had written to Egg before I discovered forum ,explaing circs and offered them £1 per month.I signed a Standing order to ARC for £1. per month for the next 999 months (yes 999 months).Arc claim thay have now provided proof of debt and are asking for full payment within 10 days.Where do I stand, especially if they take this months £1 payment.WHEW sorry this is so long .All help much and advise appreciate and welcomed.I have just gone online and ARC have taken this months £1.000

Hi all well my 12 +2 days is up today and Lloyds sent some bumf through the post but I do not think it is a copy of my signed agreement. They letter says thank you for your request under section 78 of the consumer act 1974 and they have enclosed a copy of the current t&c which apply to my acount. They have also enclosed a signed statement from the above account wich is August statement with someones signature on it. Where do I go from here I am sure this was not what they should have sent. There is no credit limit and no signature of mine.February 2013 NSD - 40
