    thanks rog, ill do just that and take the driving seat, altho im not running away from these debts i just wanted to take control and be in control of what came in and went out from now on. I dont want it to come back on me and bite me in the a** if i did make a payment admitting just now so i think ill sit tight and keep sending out the appropriate letters and see where it takes me. i am willing to go the full hog and as ive always said you dont get anything if ya dont ask for it and i use that for everything in life hehe good luck to all who follow these threads xx ill keep posting updates

    another thing, i may need a huge filing cabinet for all these letters coming and going out hehe. i have about 14 creditors so 14 different envelopes for each one all containing correspondence from their first contact and me sending out cca requests, to their response's and plan on keeping envelopes as well from now on haha i feel a little more organised since all this came about. I totally stumbled across this and was not aware of my rights until i started to read a bit on the forums and slowly but surely im getting there and taking these on and like someone said before, i actually look forward to getting my mail in the morning now and seeing what response Ive got. Its all about feeling in control of my debts and not hiding away hoping they will go away, but now that i am back in the driving seat i plan to stay there.

    Ok folks have no idea what to do now!

    I posted a few months ago about DH credit card. Basically it had been passed to a company called Apex. With the help of all you lovely people I sent them a letter requesting a CCA accompanied with a PO. They sent the PO back and advised that we would need to contact the OC (Northern Bank) and that they would put the account on hold for 14 days.

    This was followed by another letter the following day stating that after 14 days the account would no longer be on hold. I phoned them (bad I know but anger took over) and stated that even after 14 days they could not legally enforce the debt as they could not provide a CCA. And I was advised just to ignore the letter and that the account had been placed on hold indefinately. Mmmmmmmmm!!!! This all happened around the middle of June and since then we have heard nothing!

    We are not trying to side step paying this debt however what the DCA didnt seem to understand is that we cannot give them what we dont have! If they had accepted our inital monthly offer they would have had 75% of the debt re-payed by now!

    Basically I am left wondering what we do now?? Can anyone help?

    That is absolute hogsh1te, Loopy. By virtue of the fact that they were chasing you for payment, they are legally obliged to provide you with a true copy of the original consumer credit agreement within 12 working days of receipt of your letter.
    Returning your PO does not, in any way, absolve them of their legal responsibility. Apex are now in default of their obligations under the Consumer Credit Act, 1974.

    You should send Apex a copy of the 12+2+30 day letter, that you will find on the following link:

    Have you put the fact that the DCA and the OC are in default and sent to both?

    If so there is nothing you can do but wait for there next move.

    You can ask for them to remove your data as they have not proved they have the right to hold it, that effectavly means the debt would disapear too so getting that done will probebly be easier said than done but besides that, and complaing abot there action to the regulatary bodies theres not much else you can do
    Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(

    Not if you have already requested the cca from Apex.

    quick update from me..
    have sent letter to impact collection ( working on behalf of vanquis ) stating i am amused as to why they are taking legal action as account in default as of 24th july... also sent them a copy of the cca request i sent to vanquis , so see what happens next...
    heard nothing at all from kays ...:rolleyes: yet !!
    still unsure what littlewoods are playing at by having TWO dca's for one debt:mad: ....

    One post then I'm out of this thread. I can understand if someone thinks they may have a debt wrongly assigned to them but anyone trying to use this to get out of paying a debt they kow they owe should be ashamed.
    If you can't afford YOUR debts go bankrupt this isn't consumer revenge its consumer greed and if Martin condones this he's as bad as the rest of you.

    HI BH,

    I'm taking this route on a credit card debt and feel in no way ashamed. If there was some loophole for the creditor to use to make me pay more, they wouldn't think twice about doing so. As soon as I realised that all guilt was washed away.
