    That is not a bad idea, lm - it's getting just a bit confusing at the moment.

    Hi all,
    please can you help and advise me on what excactly a CCA request is I have heard you can ask your credit card company to prove they have one. if they can not prove this you can have your debt wiped is this ture?

    Yes and no. If a CCA is not available then the debt is not enforceable in a court of law. Its not wiped and it will remain on your credit file. The creditor can still chase you for the debt (but not harass).

    A CCA is a true copy of the original signed credit agreement when you took out the credit card.

    can i ask what happens now after cca requests have gone out and had just a handful of blank ones back, ive sent reminder letters asking for the true original and what they have sent is not what i asked for etc...30 days isnt up yet but can i just ask what happens when all is dusted with the cca requests what path do i take. I have never signed any cca with catalogues i owe money to so i know they cant find an original, and it seems to me even when 30 days is up they wont be able to provide one.most of my catalogues were took out early 2000-2003. Since my last post over a week ago my partner DID get made redundant which we didnt need but its not the worst thing that could happen. I just want to know what comes next after the 30 days and i make an official complaint to the oft for not providing the statement of account and cca, surely they cant just wipe off these debts and will pursue them in other ways possible. Do i contact them with maybe a lump sum offer and say its all i can afford to pay since we have no income and we have over 35k of debts between us, mine are not all that bad around 6k off catalogues but we have combined each others debts and facing them together, the most i owe to one is around 2k so i was thinking maybe offer 100 or 200 depending on spare cash ive acummulated and ask for them to take it as final payment. also my name isnt on the mortgage just yet so as far as they know i have no assets so surely they may take the offer of a small lump sum and clear the rest. What do any of you suggest.

    Basically, dmd - what happens now is entirely up to you - the fact that none of your creditors/dcas have been able to provide you with a true copy of the original signed/executed cca, puts you in the driving seat, rather than them.
    They can, no longer, pursue you through the courts and, if such is your wish, you can tell them that you will. no longer, be making any payments.
    I would, however, urge caution on 'making a full and final settlement offer' based on the fact that they were unable to provide you with the cca, as this could be seen as an admission to the 'debt'.
    If you wish to go down this route, do it only after discussing it with one of the debt charities.

    Ok, I've been reading this thread and am really interested as I found this compnay http://www.creditissuesltd.co.uk who look like they do what you people have been doing.

    Is there a walk through or faq guide to this process? Do the agreements have to have been taken out before 2007 for this to work etc??

    Help would be appreciated.

    If they do try and pursue these 'debts' at a later date, you need to send them the letter that you will find on the following link:

    Adam - I would hope that nobody would even contemplate going to a Company that offers a service to 'cancel your loans' when what that company is in effect, doing is to request the cca and, if one exists, find flaws/mistakes that render the cca unenforceable.

    For this 'service' they make a charge of up to 40% of the value of the original loan.

    The Company that you mention is advocating nothing short of debt avoidance which is not the purpose of this forum.

    If you have specific issues, then, by all means, post them and we will, if at all possible, do our best to point you towards the legal option that deals with your issue.
