Hubby has sent a letter to capquest asking for a copy of his cca from the Clydesdale bank re his mastercard opened in 1999. Debt has been with 2 other companies prior to capquest. Going back to 2002.
They have wrote back saying the Clydesdale have said if he goes into branch with 10.00 they will provide copy statements.
What do I reply to them?? We don't live anywhere near a branch now down in England. Surely it's upto them to provide CCA not just copy statements.
Any advise please?? I've just gone BR so need to help hubby now to get this sorted out.BSC No: 186 There is always light at the end of the tunnel. Unless someone's nicked the candle !

They're trying it on. Did your husband send #1.00 postal order, use the template letter and whatever he does do not sign the letter just write his name - they have been know to scan in signatures.

They are taking that the statement "obligation also extended to providing a statement of account " as wanting all your statemants, oh dear

I would be tempted to just ignore it, you have asked for a copy of the CCA and obligation also extended to providing a statement of account and that is what they must supply end of
Just carry on and issue notice of default after 12+2.

Just to clarify, lfts:

Interesting development with Clap quest . They have sent a four page summary of the fully history of my account to date . They are so helpful !
It points out dates of letters and so called arrangements on the account . It does not mention the many intimidating phone calls pressurizing me to agree to unrealistic payments . It also refers to consumers reading websites that in there words " that encourage and advise people to request copy agreements and any related documentation in and attempt to delay any collection activity on the account or evade their debts altogether ."
At the end of the letter they write . " We are unable to hold your account indefinitely and it would seem are unable to resolve this matter with yourself . Therefore you may wish to refer your complaint to the F O S within six months of this letter."
The main complaint is they have only supplied a copy of a application form, the terms and condition that they say apply to the account are on separate pages . There is no way of being certain they are within the four corners of a document as required in the C C ACT . The battle goes on !
It is no good me getting F O S involved , they will not make a legal judgement on if a agreement is enforceable or not ! I do not think it is , they say it is . Its their MOVE ! All i will do now is give them details of my financial situation , which will show I have no excess monies and have no assets . So will they waste there money going to court ? Very doubtful !0
