    Well Moorcroft have not sent CCA as requested and i sent the original request 21st June...
    so +12 working days (then i sent another letter) +30 days gets me to 7th August but waited the weekend ;) their times is up...?

    am i right to send the 12+30 days letter now? then what do i do then after the 7days the letter says they have - am i complaining to someone?

    why send any reminders they are under the LEGAL obligation not you, i think people from this country try too hard,you have done whats legally required its their job not yours.

    I.m new here so firstly thanks to everyone for their invaluable help.On 5th Aug I sent a CCA request to Cabot enclosing £1, their reference no. and sent it recorded del.On the 8th Aug.I recieved a photostat of my letter(marked recorded)my payment and a hand written compliment slip telling me they could not find my account and asking me to phone them. I'm certain that their ref no. is correct,so do I return everything with a copy of one of their demand letters showing their reference no OR do I just ignore it ,I will not phone them, and count the 12+2 days from 5th August and then send them a default letter. Sorry this has been a bit long. Advice and help greatly appreciated.

    Number one rule DO NOT RING THEM . Everything must be in writting ,and keep copies . Send a copy of a demand letter and repeat your request , also request a copy of notice of assignment .

    Yes, NWA - send the letter. It will re-inforce the fact that Moorcroft are now in default, and the letter could be needed as 'evidence' at a later date.
    If Moorcroft are still giving you grief, them you need to complain, in the first instance, to Trading Standards/OFT.
    If the thugs at Moorcroft pass on your details - for example to another dca, then they will have acted in contravention of the Data Protection Act, and need to be reported to the Information Commissioner.

    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    Yes it does. It does NOT matter that they have 'returned' your £1. - They are STILL under a legal obligation to provideyou with a true copy of the executed cca for any 'debt' which they are pursuing. Without this they are unable to pursue the 'debt' - pure and simple.

  • hi , would appreciate some help to please ..
    i sent letters on thursday to vanquis and littlewoods signed for delivery , not received yet ; ( so looks as if i will need to post again .. does anyone have a copy of the 12+30 letter i could send.. vanquis have passed my account to a dca and littlewoods keep phoning and neither have supplied cca from the first request..so do i send the next letter to the dca or to vanquis ?
