I am a bit worried, I have had several who have not supplied a CCA way back in May, I told them they had defaulted an all the rest and they have left me alone, I am worried by there silence, especially Welcome finance, they are like leachesThis is a system account and does not represent a real person. Right then, here we go again:rolleyes: cap one sent letter today saying im in default, and they will pass it over to DCA, in same post!! had a letter from Debitas (i know they are one and the same) saying to ring either to pay full balance £1,208:94 or to speak to one of their specialist team(?)lol. Now while i am quite willing to ring and offer an amount each month i have read horror stories about Debitas, so i am not sure whether to CCA them or to set up a standing order of £10 a month wait a few days and write to them stating what i am paying them. Dont want their door-to-door folk coming, although i know they have no more rights than a paperboy, i do not want whole street knowing i cant pay my bills. What to do? have read the infamous Debitas thread and wish to god i had the guts to do that. Also have cca`d Moorcroft re: marshall ward account, they have cashed my quid but no cca. Also NDR acting on behalf of Additions have cashed the £1cheque, took it off balance, and have sent a letter today stating they have no agreement but have sent a blank agreement saying "you had one of these"!! but we havent got a signed one but you still owe £x amount. i dont know whether im coming or going.:eek:DFW NERD....560

OH received today confirmation from LINK that his Barclaycard CCA cannot be found and they therefore are returning the debt to Barclaycard. Will wait to see what happens next.
Whats wierd though is that they also sent in Mar08 (they are dealing with several debts) the correct CCA for a loan with Abbey (has all the details/interest/signatures etc) but have not asked for payment on this at all since notifying us that they taking over the debt nearly 7 months ago!0 -

This is the background and update on my experience of MH.
Statutory Demand for £4000 owed to RBS received by OH in August 2005. OH didn’t recall having account with them but not sure. I said I’d deal with it/them. Spoke to them asking for copies of statements etc., was told that papers had been passed to legal and statements etc. could take six months to get.
As neither of us had dealing with DCA’s previously we just thought we had better pay it. So I set up a £40 per month direct debit from my account (oh, how naieve!)
June 2008, found this amazing website.
July 2008, CCA Request and subsequently 12 + 2 letters sent.
Today is 12 + 2 + 30. OH received letter from MH “. . . would like to inform you that your account has been passed back to the client as our company is no longer dealing with your account”.
I shall still send the 12 + 2 + 30 letter today as they have failed (on so many levels) and I should like to attempt to have the payments returned.
So to all the wonderful people that post advice, information and experiences on this any the other threads (if that’s the right word) a most enormous THANK YOU.0 -
The infamous Connaught have returned my £1 postal order to me and told me that they no longer have the file, that it is now with 1st Credit.

Whilst that is, indeed, good news - it still does not absolve Connaught Collections of their Legal Obligations, under the terms of the Consumer Credit Act, 1974, to provide you with the said cca within the 12 working days. If anything, it reinforces the position that the 'agreement' is not enforceable.
I would act as though you have not received this letter, i.e. send them the 12+2 day and 12+2+30 day letters as and when they become due.
If 1st Credit start to pursue this 'debt' then there is a letter, telling them that they do not have the right to pursue this unenforceable agreement, that you can send to 1st Credit - I will post a link if you wish.
