    thanks fermi, just rang them for a few simple things to be explained, their sending out booklet for me to re-read over but ill have a look at the link thanks x
  • Hi Fermi, after my NEXT fiasco, (ccj) I was ready when Moorcroft sent me letter to say my Marshall Ward account has been passed over to them I cca`d them straight away, they cashed my cheque (yesterday) but in yesterdays post was the pre-court letter plus i am having a few phonecalls, I havent received the CCA so how on EARTH can they hassle me?? I fear that if I dont ring them they going to fast track this account to court like the NEXT one. They are totally ignoring the "this account is in dispute" bit.

    You just have to be ready for them . No CCA is an absolute defence against enforcement .

    just one more thing. I know non of my catalogues can produce a signed agreement by myself cos ive never signed one, ive had a reply with an amended cca from 2006 from reliable collections but all my catalogues were started before this date. What do i write to them saying since they will not be able to produce one in the time im giving them although its early days, there isnt one on file anywhere.

    This means absolutely nothing, dmd, they must provide you with a true copy of the 'actual/executed' agreement. You just need to wait until the deadlines pass, then send out the letters.

    Don't worry if they do, CW. You simply need to state, in your defence, that you have requested the cca and that they have, so far, ignored your requests (attach copies of your letters to your 'defence').
    The Court will, if necessary, remind Moorcroft of their legal obligations.

    Thanks Rog2, is there any sample letters on these posts for the next round of letters to go out to these debt collectors.

    I just did my calculations for bank charges for abbey and im owed 1,182 so woohooo only took em a year and half to send summary of charges and 20 pounds worth of postal order later, hopefully i get em back cos im meant to owe them £653 in overdraft charges and interest on top once account was closed so nahnahnah i have asked nicely if they will write off that amount since im in financial difficulty and the charges put on the overdraft caused me to default in the first place and i wasnt able to get straight again with abbey. Bloodsuckers haha

    Interesting development with Clap quest . They have sent a four page summary of the fully history of my account to date . They are so helpful !
    It points out dates of letters and so called arrangements on the account . It does not mention the many intimidating phone calls pressurizing me to agree to unrealistic payments . It also refers to consumers reading websites that in there words " that encourage and advise people to request copy agreements and any related documentation in and attempt to delay any collection activity on the account or evade their debts altogether ."
    At the end of the letter they write . " We are unable to hold your account indefinitely and it would seem are unable to resolve this matter with yourself . Therefore you may wish to refer your complaint to the F O S within six months of this letter."
    The main complaint is they have only supplied a copy of a application form, the terms and condition that they say apply to the account are on separate pages . There is no way of being certain they are within the four corners of a document as required in the C C ACT . The battle goes on !

    DITTO!;) i sat down yesterday and calculated mine £2591.00 in charges !!!:eek: letter in the post tomorrow x
