post 659 femi has missed out the word "NOT" . This point has been covered many times . If a CCA DOES NOT CONTAINED ALL THE PRESCRIBED TERMS AS LAYED OUT IN THE CC ACT , IT CAN BE JUDGED UNENFORCEABLE BY A COURT .
sorry i asked a question going over old ground stapeley, being severely disabled and having an illness that affects my memory, i find it impossible to read all the 600 odd posts about the cca's and what things mean,0 -

I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

I sent off a cca request to Capital One a few months back and they sent something back the size of a postcard that was the supposed agreement. Then weeks later we (this is my Husband's CC by the way!) get a demand from Cr*pquest demanding payment or else. So I sent them a CCA request. Today I received similar post card supposedly being the agreement. Now the two agreements have different dates and different Cap1 signatures. I think this is totally odd. The only prescribed terms is the signature (but which one?!).

Good Morning! Having received my supposed CCA from Tesco Finance (AIC chasing debt) it is according to post 664 an application form without the prescribed terms. What happens now? Do I send the letter in post 666 to AIC or do I wait until the 30 days (23/08/08, have sent that letter as CCA not received after12+2). Reading other peoples posts makes it all seem so simple but its still worrying the hell out of me!Please advise.Thanx'Neither a lender nor a borrower be'

i have just done new letter basically saying that littlewoods and vanquis are in default as not yet had a signed agreement yet , going in the post tomorrow ... will keep updating ...

i have been waiting 6 months for ccas from my catalogues....to update;-
simply be today sent an amended credit agreement for me to sign showing how they are having to update their agreements because of the 2006 act....
i have had other catalogues admit they have no cca but still the debt exists and can i contact them to discuss how i will pay - do i just ignore this? i have kept all letters...
i have had a catalogue produce a signed credit agreement for £99 but saying i owe £255 - its only a photocopy and looks like my handwriting and signature but im not sure whether they have actually copied it themselves...they said no more correspondence to go into because it has been passed to moorcroft....what do you suggest i do when they do contact me?

By default letter, do you mean the one that you send after 12+2+30 days or is there one for 12+2? Its been a while since I've had to send I can't remember.

Hi MandyLou - It is not 'simple' but, at the same time, it is your legal rights that we are talking about.
I would advise that you send the letter in post 666, as AIC are likely to see what they have sent you as the 'green light' to resume their harrassment of you.I am NOT, nor do I profess to be, a Qualified Debt Adviser. Quick update from me:
Just days short of it being 30+2 from the time I sent my CCA request in to Lowells, I received a letter from them saying 'their client' no longer had these documents so they were closing the file.
I never did find our exactly what the money they claimed I owed was for, but without the help and advice I received from many of you, I would never had known that you can challenge them and may of ended up paying them thinking I had no other option. So thanks all, you saved me £600!
