Quick update from me:
Just days short of it being 30+2 from the time I sent my CCA request in to Lowells, I received a letter from them saying 'their client' no longer had these documents so they were closing the file.
I never did find our exactly what the money they claimed I owed was for, but without the help and advice I received from many of you, I would never had known that you can challenge them and may of ended up paying them thinking I had no other option. So thanks all, you saved me £600!

i have been waiting 6 months for ccas from my catalogues....to update;-
simply be today sent an amended credit agreement for me to sign showing how they are having to update their agreements because of the 2006 act....
i have had other catalogues admit they have no cca but still the debt exists and can i contact them to discuss how i will pay - do i just ignore this? i have kept all letters...
i have had a catalogue produce a signed credit agreement for £99 but saying i owe £255 - its only a photocopy and looks like my handwriting and signature but im not sure whether they have actually copied it themselves...they said no more correspondence to go into because it has been passed to moorcroft....what do you suggest i do when they do contact me?

You should NOT have had to 'wait' for six months, magoogy. By having FAILED to provide you with the cca, within the prescribed period, these companies have actually broken the law, and have comitted CRIMINAL offences.

The agreement MUST be a copy of the 'executed' agreement. An 'amended' agreement is NOT acceptable.

'Catalogue' debt is a particularily difficult area to clarify, but provided that you took out your catalogue BEFORE 6th April 2007, then it is STILL subject to the terms of the Consumer Credit Act, 1974 and any creditor must be able to provide a true copy of the original consumer credit agreement within 12 working days. Withut this agreement, any 'debt' is unenforceable. It did change on 6th April 2007, butonly basically to give the Courts discretion as to whether any 'debt' can be deemed enforceable without the cca.

MOORCROFT, as I am sure you already know, are the Pits. Nevertheless, even THEY must respect the Law. If the 'cca' that you have been provided with, has been deemed to be unenforceable, then not only can Moorcroft NOT legally enforce it, but the original creditor will have broken the law by passing your details to a Debt Collection Agency. I would suggest that, initially, you send the original creditor the 12+2+30 day letter, as this sets out clearly that they are not legally entitled to pass your details on to a third party. Then report them to Trading Standards and the Information Commissioner for breach of the Data Protection Act.

Hi MandyLou - It is not 'simple' but, at the same time, it is your legal rights that we are talking about.
I would advise that you send the letter in post 666, as AIC are likely to see what they have sent you as the 'green light' to resume their harrassment of you.

Hi ML - I didn't think you were being rude, and I hope that my reply didn't make it look as though I did. I only meant to agree that 'nothing is simple' and that because of the complexities of 'Law' we shouldn't expect it to be simple.

thank you rog2 for your reply also - it is a very big help...thanks so much....i really wouldntve minded paying these accounts if they hadntve added so much interest, etc, from the very beginning and changing their terms from 0% credit to suddenly like 17% which i thought was disgusting.....
i am totally prepared to stick to my guns regarding these but may need the occasional help along the way and you guys are a godsend...

Hi guys, sorry if im stepping on toes and butting in, i have posted my own thread but no-ones answered yet and I NEED HELP/ADVICE.
The story goes, I have about 6 catalogue accounts nearly all 7 or more years old, all were paid up to date till a few years ago,till my partner lost job and we fell behind with payments. Kinda buried our heads a bit, but finally looking to sort this out. Have I got this right, if I have a debt with a catalogue and never signed any agreement with them since it was all done online or over phone, then I am quite entitled to ask for the cca to be produced, i know if they do produce one, my signature will never be on them so can i get away with getting these debts wrote off. Morally i do owe them since i received the goods but since im going into a DMP soon we have more going out than coming in and it would be a great help if these could be wrote off. I also have sent out my cca requests and got one back from reliable collections saying my conduct in this matter is unnaceptable and will not be tolerated <<<feels like a little kid being told off than a 30 year woman haha i think basically cos of all the letters they have sent i kinda ignored and never offered to pay. entirely my fault and no excuse but when your that down about debts i just wanted to hide and not answer anything which you will know what im talking about or we wouldnt be reading these posts. Plus my partner has an awful lot of debts through loans before i met him and he has done the same to the point something needs to be done about this now or im afraid ill lose my home. I want to try and get this sorted out so please a little advice will go a long long way.0
