the other one they sent with is is identical, except it has my married name on, and the amount for late payments etc is £12 and not £25 as on here, which i think is a indication of that its wrong anyway..
to me it looks like print outs that anyone could have done at any time..Please be nice to all moneysavers!

This looks like a set of T&C's and the "parties" bit could have anyone's name typed in.
There are more experts about CCA validity on here would I am sure will be along soon.

it has no signature on, a box for one yes, but no signature, date, nothing... I dont think its valid.
but bearing in mind the trouble i have had with h crap anyway i would like to be 100% sure before i send the default letter and tell em to go jumpalso as its my mortgage provider that concerns me a bit, cos i certainly wont get another deal come renewal time with anyone else!

Halifax have sent an anual statement of account no request for payment just a printout of the account as it stands now.
They have had no money since November, should I just ignore them.?
M&S are still being pains, have resent the letter saying they sent the wrong stuff and to go away.Barclaycard 3800

You say it is your mortgage provider ? Has it been sold on to CQ ? Have they given you a notice of assignment ? Hope you do not bank with the same people .
yeah ti s mortgage provider, Rog2 advised that they dont regard secured and non secured in same way.
no its hasnt been sold, just making token payments since jan. they havent sold it on. so no notice of assignment, i have only CCA'd em as they started to get a bit heavy. and no i no longer bank with them.. we have diff accounts with non debt associated bank, just transferring all direct debits now too.
we have never missed a mortgage payment either with them
ps, its a credit card not my mortgage that i have defaulted on. but my mortgage is with same companyPlease be nice to all moneysavers!

I received a call from MBNA yesterday making me a settlement offer which is acceptable to me - as long as that is the end of it.
I know that I need to get it in writing first, but a couple of questions:
They say that my credit rating will show a 'partial settlement', but it will be definitely settled and finished. They say that although the credit file will show this, they will state in writing it is a full and final settlement and that will be the end of the matter.
Can someone tell me what exactly is sufficient to know that it is done and neither MBNA or anyone else will come looking for me in years to come.
Also, is email confirmation from them sufficient, or would it need to be a letter.
Finally, what impact will it have on my credit rating/credit file if it shows as settled this way.

I have a couple of specific questions relating to a CCA copy I have received.
1. The CCa is on 2 seperate sheets. The first contains the relevant information. The second simply contains Terms and Conditions and signature box. As far as I can see there is no link between the 2 pages, they are not numbered. Has anyone had any had any experience of this and where would I stand with regard to enforceability?
2. A signeture box has a signature but is not dated, therefore is the document properly executed?
3. The agreement has no credit limit specified, just a vague sentence relating along the line of letting me know what the limit is from time to time. It is what I think is called a 'running' agreement. Again does this conform with the CCA Act 1974.
I have tried reading the forums relating to the above but cannot seem to find the relative info.
The agreement was drawn up in 2001.
Advice much appreciated.0
