    We've had another letter from CL Finance, demanding a payment and threatening court - do we continue to ignore it?

    Have they provided a copy of the CCA ? If they haven,t then I would ignore . I,m now getting alsorts of settlement offers from CQ . Discount offers and low monthly payment and no interest . One thing they are not offering is a copy of a SIGNED CONSUMER CREDIT AGREEMENT .

    I have just received a couple of cca's back and have a couple of queries. Wonder if anybody can help.

    Having the cca 1974 act i note that it is is a requirement that the credit limit be stated.

    As neither cca copies have an amount stated, just 'we will from time to time tell you what your credit limit is' , does this render the agreements unenforeable? Does anybody have any experience of this? Both agreements relate to running credit facilities, ie not fixed term.

    Secondly, do agreements have to be signed and DATED in the specified customer box?

    Marks and Spencer are now sending it through to a DCA oh I'm so scared. They are also refusing to speak to me at all as telling them they are wrong, to stop phoneing, produce a CCA or go away is deemed to be rude and threatening. Of course they want to speak only to DH they frighten him and make him ill. On the few occasions they manage to get him he will agree to anything. Much easier for a company to deal with a seriously ill frightened man than a confident woman who knows her rights.
    They claim they have sent a CCA out three times yet have repeatedly admitted in their calls that they havn't. They will be pleased to have driven me to tears again.

    Hi Kudox, NO, the Chester Park address IS correct, you'll see it at the top of every correspondance. They seem to have either a problem receiving letters OR as I suspect, lying about the issue. ALWAYS send by recorded (2nd class is only a pound or so). They continued to harras me by phone, acting as though they had not recieved any CCA request etc. They had the audacity to blame Royal mail etc. After I challenged them, they asked for copies of all my letters to be sent again. I did this together with proof of posting.

    Unfortuneatley, they then sent ANOTHER standard letter, so this time I sent a letter to thier customer assistance department (!) to complain.

    Now, the funny bit. One of the letters they claim NOT to have received was actually an agreement to pay them a settlement figure THEY had proposed!!

    To repeat myself from another post - just how stupid do you have to be to work in finance!!.

    Hello brokenhearted. I'm so sorry to hear that. Please don't despair, although its easy to say from a distance.

    I've been thru it, and still am, and the only hope I get sometimes is through this forum. Not just practical advice, but a feeling that we're all in this together.

    People who work in these call centres are a sad bunch of !!!!!!!s (I'm not going to apologise for not disguising that word with symbols either). At some time, what goes around will come around. Their is NO distinction in my eyes from them and the organisations they work for.

    Please don't let these bullies win, and if you want to PM me you can, or just post here.

    MBNA have sent a (standard letter) today saying they are "preparing your account to be written off as a bad debt. Please be aware this does not mean it will disappear. After your debt of xxxx has been written off we will pursue one of the following actions to recover the debt"
    They then go on to say the usual DCA stuff.
    Interesting language I thought "written off" ? Whats that all about?
