    hi there , i sent them all signed for .. on the studio agreement it states they will detemine my credit limit under this agreement.. APR is 29.5% if paid by direct debit or 44.9% if paid by other methods.. where my signature should be it states : This is a credit agreement regulated by the consumer credit act 1974. sign it only if you want to be legally bound by its terms. also in small print under additional terms and conditions it states ..if any provisions of this agreement are found to be invalid or unenforceable the remaining provisions shall continue in full force and effect...but at the bottom states By signing this agreement you agree to be bound by the provisions and those contained within your catalogue.
    p.s with the letter that came with it , it says thank you for your letter dated 4th june.. in order to comply with your request i have enclosed a sample credit agreement etc.... please be advise that this debt is at our internal debt collection department .

    Did they ACTUALLY say in their letter it's a SAMPLE Credit Agreement?

    Also when you say they wrote your name and address on it - is this fresh ink i.e. obvious its been added to a blank form for this purpose?

    Something doesn't seem right here and I would suggest they have not fulfilled the CCA request by sending you a SAMPLE CCA and doctoring it with your name and address.

    I am sure someone else will be along on here to confirm/deny that, as I am no expert compared to some of the people on here, but that what it looks like to me.

    yes on the letter i recieved it states as follow : Thank you for your letter dated 4th june 2009 which has been passed for my attention. In order to comply with your request ,i have enclosed a sample credit agreement.
    On the agreement my name address and account number have been put in using a blue biro pen.

    Looks to me that they have not fulfilled your CCA request. Send them the 12+2 letter at the relevant time and see what they say then.

    Be careful Redrobbo with MBNA. They have a tactic of denying receipt of mail, even when you have proof. They even tried to blame Royal Mail AFTER proof of reciept was shown to them. Was it to a Chester business park address?

    Hi, is the Chester Business park address the wrong one because thats where both our letters have gone and a couple of months later we have heard nothing regarding the CCA reqeust, but they are still phoning and writing with the usual threats though.

    I have a query with regard to a CCa I have recently received. A little different to the usual I think.

    The problem is that a 'substituted' creditor is involved.

    The agreement received is obviously not the original agreement as the two organisations had no connection when I opened the original account and I have not received a new agreement to sign.

    Therefore have they provided me with a valid agreement?

    Thanks in advance.

    Also the new cca has not been dated by myself and it does not contain the credit limit, it is a 'running account'
