    they never came.... also received a quite nice letter apologising for the misunderstanding as they meant they were going to ring my house... which is bol**ocks as they dont have my number and complained in the orig letter that they couldnt get through to me!!:rotfl::rotfl::rotfl:

    I don't think bailiffs can come around until you have a CCJ and have then defaulted on it? But I may be wrong?

    Just ignore them when they call, they probably wont call, they just send it to scare you, so you ring them up and agree to some ridiculous payment that you can't afford.

    I have had several of these types of cards and only once has someone turned up and I just told them I was in negotiation with CCCS and so wouldn't talk to them, although I do have the benefit of living in apartment so told them that through the entryphone :rotfl:

    Don't let them intimidate you, that's what they want to do.....

    Hiya,

    Please dont worry about this. It is just scare tactics.

    Only a court can can send a bailiff to your house, and like has already been said, only then if you default on a CCJ.

    Some DCA's try to make you believe that they have the same rights as the courts, but they dont!!!;)

    If they do actually send anyone to your house, simply tell them (very politely;)) where to go!!! They have as much right to enter your house as the local paper boy!!! NONE!!!

    Also, report them for trespass if they step accross the boundary of your property!!!

    Debt collectors are not bailifs, and not even bailiffs can act without the right instructions from a court.

    Debt collectors that turn up on your doorstep have no power to do anything. If they don't get off your property the moment you ask them to (and you should do that the moment they say who they are) then phone the police and report that they are causing a trespass and a breach of the peace.

    Hi Kinjo,

    I had the exact same card - its worded this way to intimidate. I called them up and went ape at them. The woman on the other end of the phone then told me that the card meant they would 'call' by phone.

    I think if every one of us who received this card forwarded them to the OFT they would be not look favourably on this company.

    Keep with it, its just part of the game. I know its hard to treat it as a game when its so important and I don't always manage to do so, but its the best way. Every time you get something like this, think of it as just another step in the process. Don't let the b@st*ds grind you down.

    Hi, I've just had my third call from Mercers in 2 days, this time at 8:30am waking up my wife.

    I've told them not to call and I've sent them the suggested letter from here informing them that it is harassment.

    This time I'm going to complain officially. Can someone please give me the correct address(es) to complain to and also if there is a standard letter for complaints and where I can find it.

    Mercers also told me that Barclaycard only need to send a copy of the T&C's, not an agreement. I disagreed, but also didn't bother to tell them that I'd also sent an SAR, so either they haven't got the CA or they are deliberately withholding it. Either way they are in breach.

    Any help with the addresses appreciated.

    Hi, sorting out some of my mums debts and on to the last couple now out of about 10 , mostly through arranging payment plans with DCA'S then purposely not paying after a month and saying a friend can make a small payment to clear it and so far all have gone for it.

    This was before i really knew about other ways to look at debt and what things are enforceable so probably paid out more than needed but atleast they are now settled.

    She had a Vanquis debt of about £600 (dark days of using the card just to buy food , at one point when i was in bother a bit too and living at home we had about £1200 a month paying out to debts between us so once it was cleared its like having a 2nd income).

    Anyway i wasn't aware of her actually using the things she learnt from here but good old mum it turns out sent a CCA request 2nd march and she showed me copies and it was done right and recorded but never had any reply from Courtlink.Nothing has been sent since as we cleared other things and it fell to the bottom of the pile so i'm wondering if i should now send the 12+2 day letter saying they are in default and if in 30 days its an offence or would it be after 3 months anyway even if nothing else was ever sent?.

    Or should she now just consider it unenforceable and forget it , i wanted to do it in a way that it can't be passed on to another DCA, or a letter saying the did is acknowledged as unenforceable and scrubbed off as i see a few have to that effect.

    She initially had a plan agreed with 1st credit and she got a payment card from them and was paying £20 a month on time then suddenly she got a letter from Courtlink , it didn't say the debt was ever handed over from 1st credit.She stopped paying 1st credit but they never sent anything about it so wondered if a plan was agreed and honoured with one if it can be taken by another?

    There's a post about the OFT warning a DCA about their practices . I would suggest sending a copy of that to them .

    Had another (automated) call from Mercer's, this time at 11:30pm last night grrrr. They've called again this morning before 9am - double grrr.

    It felt good giving them both barrels this morning but enough is enough.
    I'd appreciate details of who I should complain to.

    They are still coming out with a load of rubbish - "CCA does not apply to credit cards, but applies to loans", "you don't sign an agreement, you just get T&C's. These people continue to live down to my expectations.

    Oh and to top it all, MBNA/A&L have sent a letter threatening a charging order against my property.

    i found the complaints address for some of my debtors on their websites, funnily enough under customer service :rotfl:

    Barclaycard, Customer Relations Department, Barclaycard House, PO Box 5592, Northampton, NN4 1ZY

    i found this on the barclaycard website, with Mercers being part of them i think it may be the way to complain about them also.
