    I sent Cap One a CCA request (template from here)..

    They sent some bumpf back about this is the credit agreement. (just a leaflet of T&Cs)

    But at the bottom of the letter it says 'You also mention a SAR, this will be a further £10)

    But I didn't mention a SAR..

    I'm new to this site and would really welcome some advice - hope this is the right thread. My situation is rather complicated. I took out a loan in 1999 for a two year postgraduate course with a High Street bank, who at the time I also had a current account with. They set up a standing order to start the repayments after I finished my course. I paid them for a couple of years, and then one month my payment bounced as I didn't have enough in my current account. I then realised that they didn't seem to have noticed that the loan account was a month behind with payment, so I cancelled the standing order and waited to see what would happen. At the time I was very badly off and couldn't afford the repayments and to be honest I can't now either. The bank never noticed that I had stopped repaying the loan! They have carried on sending me statements and interest continued to be added (at a relatively low rate) but that was it. I did receive one automated letter two years ago that said they had noticed I hadn't made a payment to my account for a while - like the kind you receive if you have to fund your account to keep an overdraft. I made a small payment as I was worried but I heard nothing further.
    I no longer use the current account with them and the loan has never appeared on my credit checking file. I have a copy of the credit agreement but something has clearly gone wrong in their systems. The whole thing is very odd.
    Is it worth me writing to them asking for the agreement etc? Sorry for the long post. I now owe them £15,000.
  • Hope some of you great people can help. Sent out request for CCA letters and got first reply today. It is from Cap One and they have sent me a letter with the heading 'Terms of your Capital One Credit Card Agreement' and it states that overleaf are the current terms of my agreement with them. In a box at the top of the letter is a box with the credit limit stated and also my account number.

    It also says that to see the rest of my terms and conditions please see the enclosed leaflet. As I am not sure what they are supposed to send out not sure if this is it or not.

    It says that 'this is your original agreement, and if any terms have been varied, then the copy agreement will include the updated terms. In addition, your personal details, the signature box, signature and date of signature have been omitted from the copy provided as permitted under Regulation 3 of the Consumer Credit (Cancellation Notices and Copy Documents) Regulations 1983. Help!! Thanks for reading and hope it makes sense to someone.

    Hi Guys,

    I recieved a postcard form a DCA today stating..

    "I CONFIRM I WILL BE CALLING ON: FRIDAY BETWEEN 8am-9am."

    This account is in duspute with MBNA and MBNA passed the account to the DCA AFTER it was in dispute...They didnt even bother to reply to the CCA request.

    I sent the DCA a letter stating the account is in dispute with MBNA and they had no business passing the account on and as such were breaking the law.

    The DCA ignored this and kept calling day after day, so i sent them a "Telephone Harrasment" Letter.

    Since then they have stopped calling and today i recieved the above postcard.

    So what do you think? time to report them or just ignore them?

    I am worried that Baliffs will turn up at the door, can they do that?

    as far as i know, even if they turn up at your door. They cant just come in, you are entitled to not answer the door if you see what i mean.
    have you CCA'd the dca themselves??? they may not take any notice though as they think they can do as they wish :rolleyes:.

    Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.


    There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.


    here is the bit i put in a letter to h crap about their threat, think it was rog2 who helped me with it.
