    Keep with it, its just part of the game. I know its hard to treat it as a game when its so important and I don't always manage to do so, but its the best way. Every time you get something like this, think of it as just another step in the process. Don't let the b@st*ds grind you down.

    Hi Guys,

    Need some advice if you can.

    MBNA havnet sent me a CCA or even responded to itfor over 2 months(12+2 was sent over month ago) , they sent a letter today stating that as i havnt made an effort to bring the account up to date that it would fall into a default and as such my credit file will reflect the missed payments.

    Is it time to make a complaint now? if so to whom?

    Hi, its not enough, they have a legal obligation to fulfill your CCA/SAR request.

    Im going through the same thing with them, they can keep adding charges and interest to account if they like but if it ends up in court then they will have to remove those charges as well as the arears on your credit file. As the account will be in dispute on the 12+2 if it isnt already so.

    Point is you asked for a CCA they didnt fullfill that request by failing to suppy a VALID CCA, instead they sent you T&C's which DOES NOT fulfill a CCA request, so send them a 12+2 letter when the time limit expires then ignore them. You can if you wish report them to the OFT or TS if they keep chasing you for payments.

    Hope this eases your worries.

    Thanks for this, but I've long since sent the 12+2 - back in April (CCA AND SAR in March). Nothing is changing. What I really want to know is what breaks the pattern? Since March/April, they've been continually sending letters and phonecalls, adding interest and charges and threatening debt collectors and defaults etc and adding missed payments to my credit file.

    What I want to know is what brings this to an end?

    I'll have to be brief as I'm in the middle of doing the tea..

    Had an outstanding debt from littlewoods some years ago of just under £160. CapQuest picked it up Dec last year, I wrote in Jan requesting my CCA. The account was placed on hold, they wrote to me at the start of Feb to say they are still looking into it. I then received a letter last week stating basically that they can't find it, they are closing the account and removing any defaults on my credit file within 14 days!! :T

    I am currently sending CCA req letters with a much larger debt but I'll let you know how I get on with that one

    Hello Kinjo,

    You may have seen my recent posts on this particular bunch of !"£$%&*. Anyway, I've just gone thru my files and this appears to be the tactics they employ:

    1. Ignore the customers request for a CCA
    2. Continue to treat the customer as refusing to pay
    3. Ignore any correspondance from the customer from 12+2
    4. Continue action 2 until the customer complains (over the phone, as letters to them don't work)
    5. On hearing the complaint, continue to deny receipt of any letters. (Blame Royal Mail, despite signed-for proof)

    You must then demand to speak to a "supervisor" (please... don't laugh, they do have another level of moron).

    At this point, try to break thier serve by telling that person what you've told the phone monkey already. Then:

    a. Demand a fax number to send copies of all correspondance and proof of delivery
    b. Fax it off
    c. Confirm receipt of fax by telephoning them.
    d. Sit and wait.

    They cannot deny that you've made a reasonable attempt to contact them. Then write a complaint letter to:

    Jennifer Matthews
    Head of Recovery and Risk Operations
    MBNA Europe Bank Ltd
    Customer Assistance Department
    PO Box 30
    Chester Business Park
    CHESTER
    CH4 9FD

    Explaining how crap they are.

    Please post results as MBNA are employing these tactics in a deliberate attempt to evade their legal obligations.
