    I personally think you would be a great asset to this site if you stopped judging people as all the same, you could stay anonymous and offer some tips to people who are genuinely struggling and need help.
    I myself enjoyed a debt free life until a plc company went bust owing me a fortune and it mushroomed from there. nobody cared, so I fight!

    They rekon it does, I and people on here rekon it doesn't, so I asked them to send me another copy and hightlight where they think the prescribed terms are.

    Also said that I'd not make any more payments until they produced their evidence and if they dont like it then pass to solicitor for litigation and that I would fight it in court.

    Hmmmm. Yet some poor person who wrote all their problems down yesterday also got the same short response off you, it might be worth your while apologising on that thread too. Your "well I'm sick of seeing this sort of thing" attitude is disgusting. As I've said, people have different reasons for being in these difficulties, it's not for you to judge.

    i wonder how the credit crunch is hitting Chester and its inhabitants and wondering when the next wave of job losses will come from a few of those plc companies sophie you have mentioned

    i know in reflection myself what you said about companies that charge people and perhaps do give them false hope in your eyes but i suppose those of us here and on cag are a lot wiser from experience and we are finding out in our own ways we dont need to use those companies

    the banks sometimes and debt collection industry try to skirt around the legal hoopholes they try and blind the consumers with, but then get caught out in court ;)

    if they processed the legal paperwork, kept the legal paperwork as the law states they have to, ie even the Tax office say that companies have to keep records at least 5 years after a contract has been terminated or closed down -why make things more difficult, this is why im fighting back because the law is there to be upheld for all, consumers and big plc 's

    whichever company you do work for, continue but i assure you - you will never have the great pleasure of speaking with me

    of those companies, inlegible agreements, some without any terms, and they state they will be taking the court action route,,,, now i say bring it on, lets see how far they manage to take that route,,, mind you i will be looking at cpr route as my next consideration, that will wake up the legal bods sleeping in the corner dont you all think

    Good morning everyone

    I need some advice on what to do requesting a CCA,I sent letter to 2 creditors 13 days ago requesting CCA's inclosing a £1 postal order,surprise,surprise,nothing has come back
    Could someone please point me in the right direction as what to do next as I am a bit clueless on the CCA stuff

    Everyone's story is different and the vast majority of those I come across have reasons other than this for their debts. Even so, don't those who have over spent also have rights to fair treatment and protection under the law? Most of those who have overspent haven't done so fraudulently, but have rather had a change in circumstances that's had a devastating impact.

    Why shouldn't those people - me included - avail themselves of their legal rights and why shouldn't the credit card companies and DCA's live up to their legal obligations?

    The hypocrisy of the banks and credit card companies in refusing to do so would almost be laughable if it wasn't having such a real and hurtful impact on so many.

    Oh and when I'm working 80+ hours a week, trying to resolve my debt issues and keep a roof over my family's heads, I can live with your lack of sympathy and feelings of sickness and prefer to thank those who show a genuine interest in offering help and support.

    As far as I was told you have to leave the request for your cca 14 days before
    you can issue the follow up 12+2 day letter. (account in default)
    Remember to send everything recorded delivery and print your signiture do not
    sign by hand.
    A template 12+2 day letter can be found on this site.

    Not quite right WW. After 12+2 working days since posting the initial CCA request (I always go with 12+1 from the date they signed for it) then you can send them the 12+2 days letter (account in default).

    The 12+2+30 days letter is no longer required.

    However in saying this I am trying a little experiment after a conversation with Rog2 ages ago. I sent a CCA request to Hillesdon (dlc) and they have kindly written back to say they are looking for the CCA blah blah blah and will contact me in 21 days (or before if they come up with something). That was before the 12+2 days which lasped a couple of weeks ago. I have not followed up with a 12+2 days letter since (because of conversation with Rog2) they know the law and should know legally the account is in default and it's not my job to remind them.

    I have had another letter from them saying "they are still trying to locate CCA and will respond in 21 days" - so they keep extending the 21 days for themselves.

    I may eventually send them the 12+2 days letter but for know I will leave it for a while to see what happens.
