Hi all,
Well, the 40 days came and went with regards to my SAR request from 1st Credit. All they sent within the timescale was 7 pages of computer printouts detailing their dealings with me. (Details of payments made, times of phonecalls, dates of letters sent, and details of which department was dealing with the account etc) Nothing really of use!:rolleyes:
No sign of any statements, or more importantly, a signed credit agreement.
I sent them a default letter on Monday stating that I wasn't impressed and wanted all missing documents sent out within 7 days otherwise i'd stop all payments to them and remove them from my DMP.
I've today received a package from them containing statements for the 3 years up to the time the account was sold and closed. So this is from 2005 up to May last year. No covering letter, just a "with compliments slip". Also still no credit agreement.
They reveal some interesting details:
Over £300 in charges.
Up to £50 per month in mis-sold ppi payments.
Nearly £1500 added in interest from when I stopped the minimum payments up to the time of default. (They were aware of my financial position during this time.)
I've a couple of questions:
Why have they only supplied 3 years of statements, and not all of them?(The card was started in 2000) There is plenty more ppi to reclaim from months prior to this. Are they required to send all statements?
Can I reclaim the added interest as I believe it to be unlawful. They knew (Goldfish) about my financial difficulties and my DMP, yet still applied this extortionate interest every month taking the balance £1400 over the credit limit.
Who do I reclaim from? Goldfish or 1st Credit. Each one says the other!
And still the wait for the exact copy of the CCA goes on.........................
Any advice?

Had a final response from Capital One saying they weren't in default although they are. Sent them a follow up letter saying they had to at least tell me if they were in posession of the original signed agreement but they won't even do that. They've now told me that's it from there end and I should now take my issue up with the Financial Ombudsman. Does anybody have a standard wording of what should be included in the Ombudsmans forms so I can start that process rolling?

I sent off about 6 CCA requests on the 3rd April, so far I have had a lot of letters back saying they are trying to find documents etc etc, is there now another letter I have to send out ?

I am also looking for a template to send out a 2nd letter request my CCA, does anyone have one?
Can anyone let me know also about a CCA that I have received from MBNA, for an only application in 3/2006. the pages do not relate to each other in so far as numbering. further more there are only 3 section, Key Financial information, Other Financial information and Key Information, Does this sound correct?

Hi all,After sendind a CCA request I have had a letter from Marbles(bank of Scotland), saying they are "unable to provide historic terms and conditions/agreement", all they've included is a copy of the current T&C's with my current credit limit on it.
Also they say they are not obliged to provide "all three items" I have asked for.
Am I right in thinking this means they are now not supposed to pass the debt on, because they have been threatening to do so recently.
What do I do now, if anything, they have started to play nasty recently adding charges and interest etc even though I've been paying them on my DMP since October.
Just wondered if I could maybe use the fact they have'nt got the CCA as a way to force them to stop the interest etc.DMP Support Thread Member 238DMP started October 20080 -

Just the standard 12+2 day letter, natasha - just ignore any letter that says they are 'trying to find documents' - once the 12 working days have elapsed (by my reckoning, an assuming that they received your requests on either the 6th or 7th of April, their time elapsed either yesteray or Wenesday) they are 'in default'.
