Hi, I'm just about to send a CCA request to Egg, I have two credit cards with them taken out at different times and they've sent a default notice for one and I expect the other account will be defaulted next week.

As the accounts are still with Egg at the moment does the CCA request need to ask for "statement of account and notice of assignment" as well as the credit agreement, or are these only relevent if it's been passed to a DCA ?
[FONT=&quot] I'm not sure what they mean :o

Also can I just double check here before I send it off if it's ok to request the CCA for both accounts in one letter with just the one postal order for £1 or is it £1 per account ?

    Thanks.

I'm not an expert but I think that it £1 per account. You would also be better off sending them in different envelopes. Dont forget to send them recorded delivery and don't sign anything.

    HI,

If a creditor is granted a CCJ against you does that mean that they have produced the original agreement to the courts?

    thanks

    Hi All,
Look out for these hidden cost when using a debt management company.

I have just stopped using a company call "Debt Free Me". We started using this company and a DMP in 2007. The first three payments where to be paid to them to cover their setup cost This totalled nearly £800 which could have gone to my creditors. Also, I found out recently and this was the straw that broke the camels back, thet where deducting £25 from my monthly payments for their admin fees. So I have decided to sack them.

Could anybody recommend a reputable and free debt management agency.

    Thanks

I can recommend CCCS as so far they've been great with my DMP and are used by lots here, there is also Payplan which a lot of people use, both free and reputable

If a creditor is granted a CCJ against you does, that mean that they have produced the original agreement to the courts?

    thanks

its been over a year since i did the cca request with studio and got the final letter saying the account would not be persued - now they have come back again like a bad penny asking for payment - do i reply to them or just ignore them? i have kept all communication from the very beginning and most of this account owed was made up of late payments/interest and other charges....

Providing they haven't sent you the CCA i'd ignore it.

No, unless you challenge the debt, i.e in order to be awarded a CCJ, you have to admit the claim, if you dispute / deny the claim, then it's listed for a hearing, no CCJ is awarded until the outcome.

If you admit the claim, the claimant is awarded a CCJ by default.

That's why it's important never admit a claim, unless you're 100% sure you'll never challenge it in the future.

All of the above organisations are charities, and fully endorsed by MSE/DFW. Their advice is professional, confidential and free.
