    MBNA have finally replied to my CCA request about 6 weeks after the 12+2 ran out although they haven't actually sent anything - only saying it will be sent under separate cover.They've then enclosed a SAR form requesting a £10 fee as well as proof of identity (e.g copy of passport to include signature). I assume I just igore this for the moment and wait to see what they send under separate cover and definitely don't send them anything with my signature on it?

    "2nd Letter" meaning 12 + 2 letter, which I have sent to HSBC and EGG dutifully.

    How can I check the CCA received from MBNA, any thoughts or pointers.

    They tried that with OH - he totally ignored it (from a compliance PoV), but wrote to them pointing out he doesn't *have* any form of ID they want, and even if he did, how are they going to check the passport is his? Turn up at the front door and check him against the photo in it? As a more serious matter - if they weren't sure they were dealing with him previously, why have they sent so many letters detailing personal/private/confidential information to this address, surely that is a breach of the Data Protection Act? So either a) they admit they have been sending things addressed to Mr PixiePie illegally, or b)they don't actually need the extra ID - either way they don't get the signature. They have failed to respond to this many many weeks later - they have sold the debt to a DCA, but raspberries to them as the account is still in dispute. It's just a tad annoying as it means writing to both MBNA and the DCA reminding them the account is in dispute so they just broke the rules, and also writing letters to report them - argh - why can no-one just either do their damn job or ignore Mr PixiePie please - the writing endless letters saying 'you are a very bad naughty company' is very very tiring (and you can see why people just pay up in the end).

    Grrr - rant over :)

    Hi,

    I've sent 12+2 letters to all those who haven't replied (or inadequate reply) to CCA request. I'm still getting monthly statements and letters with increasing balances due to interest and charges. I'm also getting daily phone calls despite formally requesting they stop.

    What do I do? Do I write to them and tell them to stop, or ignore them?
    Also who do I write to to complain - OFT; Financial Ombudsman; Trading Standards - all of the above? Do I need to send these recorded delivery - its getting expensive all this letter writing.

    Tomorrow is 40 days since I sent SAR's (should this be working days, or just 40 days). I've had only 1 response out of 7.

    What do I do next? :confused:

    This is 40 CALENDER days, not working days.

    Not 100% sure on this as i'm in the same boat here with regards to 1st Credit.

    I sent them a letter stating that the time was up for the request and if they failed to fully fulfil the request within another 7 days, I would report them.

    I think you need to report them to the Information Commissionner. That is what I have said I will do if they fail to respond.

    Whether the Information Commissionner will do anything about it is another matter.:rolleyes:

    Just wanted to say thanks to everyone for helping me on this thread, anyway just to let you know I sent my first lot of letters on the 3rd April req the CCA, Ive now printed the second lot to record delivery to go out today, hope this is all correct ??

    Ive had replies back from the first letters but mostly saying they are looking for paperwork, Ive had one lot Eversheads (northern Rock) who are now threatening all sorts though.
