Thanks Rog2 - and I have to say I agree with 10past6.
This is the reply I've been waiting for and is a real help in giving me direction as to where I go next.
There have been moments when I have nearly given in - hence the mention of IVA - but these moments have passed and my resolve is stronger than ever. My only issue is that I don't know enough about the facts and hence the need for guidance at certain points.
I did speak to CCCS who advised me of the IVA route. I haven't got anything but good to say about them, because they helped, but what they had to tell me made me realise that there are other options.
Anyway, I now know the next step, so thanks again Rog.แล้วไงต่อ0 -

While i totaly agree with rog2,s responce, which is correct as always, to the letter, just remember creditors dont play by the rules, which was the point to my post, if you have nothing to lose, you have nothing to take, it helps when you see it that way, it brings the threats, empty or not, down to size.
If you can change your number, you should not have to, but if your strugleing with the constant calls, its the only way to stop them in a realistic timescale, the herassment letter is for the most part ignored.
I understand not everyone can just change there number, but it does make dealing with this easierThats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all ………….0 -

Thanks, its a good idea to change the number and I appreciate the suggestion, but I'd sooner know what they are doing - i.e. whether they are continuing to call or not, so I can cope with it bar the odd moment and my view is that I've had the same phone number for nearly 15 years. The people I want to call me know the number and I'm not going to change it because of some annoying credit card company.แล้วไงต่อ0 -

hiya i understand totally your stress over this
i sent the harrassment letter and got a long winded reply that they could call so many times etc etc
so i got myself from the consumeractiongroup site truecall device
so they call and ive set it to call but we dont hear the phone and it stores the info for me and i can then see who has been calling me anyway
can do lots of other stuff too and you can record conversations too if you have the memory card thingy too
well worth the near 100.00 for my peace of mind, i wish i can win that lotto cos i would buy each and every one being hassled by these phone calls a device
by the way blind as a bat, hope you are okay and keep strong in this journey of ours
take care all laters mazSealed Pot Challenge member 1525

They didnt send the agreement within the time period so I sent them the default letter. The have sent me another letter saying they cant do anything without a signature and have sent the £1 postal order back for the second time saying theyd waive the fee. what do I do now?

Hi, I'm not an expert, but until someone more knowledgable comes along....
As far as I'm aware, the fact that they have not cashed the postal order and returned it is irrelevant. You have fulfilled the requirement by sending the request. If they do not respond in the prescribed time scale, they are in default. You are not obliged to sign the request.แล้วไงต่อ0 -

You don't need to do anything, uf - HSBC are now 'in default' and can not enforce the agreement whilst they remain in default. It does not matter that they have returned your £1 Statutory Fee.
Keep copies of all of your letters in case they decide to take you to Court, as these will form a very important part of your defence.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
