    How is this for a template given the recent MH ruling?

    Dear Sir / Madam

    I do not acknowledge any debt to your company

    Ref:
    Regarding your letter / phonecall / other communication regarding the above alleged debt.

    On dd/mm/yyyy I made a request under the Consumer Credit Act 1974 (Sections 77−79) for a copy of the Consumer Credit Agreement that details the necessary information appertaining to the alleged debt.

    You have failed to provide this document in the necessary timescale / amount of detail.

    A recent ruling by the Office of Fair Trading against a certain debt collection agency, states that

    • (the DCA) will not carry out Debt Collection Activity where it has been informed, in writing, that there is reasonable cause to believe that
    the debt is in dispute.

    • A debt is considered as in dispute where:
    A request under section 77 or 78 of the Consumer Credit Act 1974 has not been complied with, and this prevents the agreement being enforced without the permission of the court;

    Given this ruling, I have today informed the OFT of your actions.

    Please do not contact me by any means until you have provided the required documentation regarding this alleged debt.

  • Hi all,

    I've just had a phone call from a company called Debt Managment Ltd re a Barclaycard account. Apparently Barclaycard passed the debt over to them today despite not having replied to any of my letters re the CCA request. The account is a very old Goldfish one which then went to Morgan Stanley then onto Barclaycard so the chances of them having the original agreement are pretty slim I would imagine. I told them they would have to pass the debt back to Barclaycard as it was illegal for them to have passed it on while the account was in dispute but they're having none of it and saying they still want settlement of the whole debt by debit card ! Do I need to go back to Barclaycard to get them to take the debt back or do I have to start a new CCA request with DML? Any advice on what to do now gratefully accepted ..

    Can anyone help? I requested a copy CCA from Link Financial three weeks ago with £1 PO. Received a letter today from them saying they need another 30 days to get the documents from original creditor MBNA.

    First time I have tried this sort of thing so not too sure how it goes. Does this seem alright?

    Any help appreciated, still a bit lost.:confused:

    Give them 12+2 days, then send them the 12+2 day letter if you hear nothing back.

    I take it you have proof of receipt for the letter you sent to Barclaycard...? You sent them recorded delivery. My next move would be to send Debt Managment Ltd the letter that tells them the account is in dispute.

    Thanks - I did send them recorded. Need to look up DMLs address now as

    No worries, there is a page with template letters on this site, but i have re-formatted and can't find the link:rolleyes:.

    Hi,

    Sent CCA to a solicitors who have been collecting from me. got a letter saying that I have to contact the original company. Did a search on comapnies house and found that the company had been dissilved in 2007. what do I do now. Do I still send the CCA to the solicitors as they are the ones chasing me for money.

    Please help Im at a loss as what to do

  • Hello Everyone,

    Can I ask a quick question? I sent of CCA requests to all my creditors. I got a letter back from Northern Rock today. This was in relation to the unsecured element of one of their Together mortgages - the mortgage part has since been paid off when I sold my house.

    The letter says:

    "In order for us to provide you with any information we hold electronically under Section 77 of the Consumer Credit Act, we require a cheque made payable to Northern Rock plc for £1.00 and signed authority from all named on the mortgage loan.

    Unfortunately your request is invalid, as you have not signed the request letter."

    Where do I stand on this? I sent a postal order and printed my name rather than signing as suggested on these boards. Do I have to send a request that os actually signed and a cheque?!

    DO NOT SIGN ANYTHING...!! There is a template letter on this. Alais i do not have the link to the page. Do a search and you should find the one specific to your situation.
