    I'm a bit confused. If a company fails to send a CCA or the CCA is not signed, does this mean you do not have an enforceable loan or credit card.

    No, not exactly, the regulations that describe a 'True copy' does not require an 'Exact copy'

    Its a game the creditors use to get out of sending an 'exact copy'

    The problem is, that may mean they dont have one, so there stuffed, or its in storage somewhere and they cant be bothered going to find it, untill it reaches court that is:rolleyes:

    Its there way of keeping you guessing, and more importantly, paying.

    Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(

    Consumer Credit Agreement -It is the document that outlines the statutory terms. This is the whole crux of this thread - simplifying things, but if they can't provide a correctly exexuted agreement, they cannot enforce the alleged debt.

    thought i would add on here what has happened to me most of mine have said they are looking for my cca, cap 1 have sent me a cca but nothing signed and now sending letters saying they want the money and argos sent my oh's cca but in the middle was a private letter which was for someone else dated 2007

    debt total on 30/07/12 is £4313.52
    water £847.75, HSBC £479.66, vodafone £262.35, Captial one £415, AA £47.97, scotcall (scottish power) £622, Arrow £420, Welcome £642.41, CSA (scottish power) £484.90, BT £91.50

    Well after 1 year and 5 months , and several differant DCA . The OC have now started sending text messages for me to ring them .This followeds the 40% DISCOUNT offer. All I have ever recieved from anyone is a copy of an application form .

    Send a copy to OFT they should be in big trouble for that !
