    It looks like a copy of the application form, MoonRose. I can't see anything about amount of credit or interest rates.

    Hopefully, someone else will also give their opinion, but, to me, that does NOT look like an enforceable consumer credit agreement.

    I would be inclined to reply with the letter that fermi has posted in the following link:

    Chris Mowll stated to me today that the rules are only guidlines which they can choose not to follow. He claims that he will send this out in writing but we have been promised so many letters now I won't hold my breath.
    Better still he kept telling me to pay the account which he has no right to do as it is my my partners alleged account. Oh and as a parting insult we are getting a default on DH credit rating for seven years. Now I'm fine talking to DCA agencies they don't bother me in the slightest and in no way scare or intimidate me. It just makes me so mad that any individual would sit and tell someone things that are not true.
    Magic and sparkle no chance. The irony is the alleged account is so small that I spent more on M&S wine last year than they claim is owed. Not to mention the percy pigs the kids eat and salads through the year. Oh well its not like they need the money from me who doesn't owe them a penny and never has. I mean its not like people arn't spending on the highstreet as it is.

    Hi all,
    I have read through most of this thread over the past week but I cannot find an answer to my question and wonder if any of you can advise me.

    I am sending a cca request tomorrow to next and egg. I have missed a few card payments over the past few months but am now up to date.

    I have not received any default notices so am wondering if the cca's are
    unenforceable (from what I read the next most certainly will be) is fighting them and essentially stopping payment worth the risk to my credit rating?

    I have a mortgage but ame currently in -ve equity so will not be able to remortgage for a while anyway - whats the worst that could happen if i pursue unenforceability?

    Sorry if this has been asked before but I could not find anything similar.

    Evening All,

    still not heard back from Nasty bank, (watch something come in the post in the morning now!)

    Bit bemused as Littlewoods and Kays have both admitted that they wont chase as no cca. yet 2 days after receiving Kays letter i recieved about 5 diff default letters (for buy now pay laters etc) saying they want paying in next 14 days...:rolleyes::p they have declined F& F 's of 20% also...

    Seeing as I have it in writing that they cant chase I am thinking i can ignore the letters they have sent??

    Tesco have finally also backed down and will accept token payments and stop interest... wonder if nasties will do the same....

    asda have passed it onto a DCA but they are honouring the current agreement of token payments for 6 months also... :rolleyes:

    Well MBNA has so far not supplied the CCA. First request, completely ignored. I then sent the 12+2 letter but have not received a response. I put in the letter that all contact must be by letter and that they may not call or pass my telephone number on. Today we received a call from RMA. Grrr!

    As it's MBNA, they may just be chasing the missed payment following the account being in default (for not supplying the CCA). MBNA do this for some reason. I guess we should receive a letter if they have sold the debt on?
