  • Guys - what to do

    Sent a CCA request on the 3rd December by registered - didn't get signed for until the 12th! Now 12 days + 2 is that from the day they signed or the date of my letter? i was going from the date they signed for my letter which is monday. I have the next letter about the account being in despute all ready to go - should i be posting this tonight so they have received by the monday or should i send it monday?

    Today i noticed they had cashed the cheque...

  • I sent a letter recorded delivery to Natwest it has been delivered but I hardly think that this counts as being signed for:

    Here,s to a better New Year ! Its been a year since I sent out CCA requests. Despite several threats of court action, I am still awaiting three copies of enforceable CCA,s .

    Hi all just like to say hello to you all and a happy new year as you will have noticed this is my first post although i have been reading this thread in its entirety before i registered.

    I myself are dealing with many crediters at the moment and will look forward to taking part in this and many other threads in the future.
    I must say a thank you to many people who have responded on this thread as it as opened my eyes up a lot to dealing with debts and DCA s

    Can you see it now? Its a distinct lack of signature I thought the whole point of sending stuff recorded delivery was that it has to be signed for?

    This thread has taught me a lot regarding DCAs - I don't post a great deal, but I do read the advice.

    I'd appreciate some advice on the following please:

    I am dealing (on my brother's behalf) with a sudden demand for payment from Buchanan Clark & Wells. My brother received a letter from them recently demanding hundreds of pounds - he hasn't a clue what this debt could be.     I'm not sure if this is Argos (he has never had a catalogue, so I'm wondering if its the evil ex again) or some sort of bank account. I also know he has never wanted, needed or used an overdraft - so its all very puzzling :confused:

    We sent the first CCA letter - they promptly sent back the postal order stating "we do not hold copy credit agreements at this office, as we are not the original creditor ... we have placed your account on hold and have requested that our client sends these documents to you direct"

    As I understood it, a CCA request means they MUST produce the credit agreement and the notice of assignment - otherwise they have no authority to collect the debt.

    So is the next step to write back and request they send the correct info? Should we return the postal order to them?

    Any advice would be great - many thanks

    They've sent your £1.00 back because they don't have a valid CCA.

    You've made a legal request, the onus is on them to prove the debt.

    Keep the letter and the £1.00 postal order for any furure reference.

    It's no longer up to you to chase the CCA.

    If you sent it to a multi organisation they're signed for in bulk, not individually.

    It's 12 working days but allow an additional 2 for posting.

    You have confirmation they've received your legal request, you need do nothing more until you hear from them.
