    Thanks for that! It will cheer my brother up, he has more than enough to worry about at the moment.

    Someone phoned him up yesterday - we think it was a DCA - they refused to tell him who they were though, and got shirty when he refused to give his personal details to a complete stranger :rotfl:

    There is a template letter to stop harrassment by telephone, although not much use if you don't know who's calling.

    Yes, I've used it in the past and it did the trick.

  • I sent a copy of the 30 days letter to Natwest a few days back. Today I received a letter back from them saying that I needed send them a postal order of £1 to get a copy of my CCA, even though in the letter I had informed them that I had sent a request along with a postal order to the debt collection agency chasing the debt (fredrickson int.). Fredrickson had returned my postal order after 5 months saying that they were no longer instructed in the matter. All this info I included within my correspondance to Natwest. What do I do?

    Write again stressing your request was correctly served under sec 77/78 of the act and included the £1 to fred, and under sec175 there duty was supply the CCA or to forward it to natwest to do so, there error does not change those facts, and natwest are legaly bound by the act to now supply the CCA, it was there agents error the £1 was returned, not yours, so you are under no obligation to re-send it too them.

    There actions requesting you send it again is a futile attempt to avoid there obligation to comply with the act, your origanal request was correctly issued, so the timescale and obligations stand
    Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(

    To everyone ! Please keep ALL letters , if you where to be taken to court , you must show that you have acted correctly .
  • Got a letter from Halifax (notice they arn't pretending to be Blair Oliver Scott anymore) giving themselves another four weeks and saying they regret we found cause to complain to the Financial Ombudsman who incidentaly only gave them an extra 10 days.
    Still sat in limbo.

    I understand why a complaint is put into the F O , but they will not make a judgement on whether a CCA is enforceable or not . Will they order the bank to cease collection activity?

    Just read your post . Why on earth will they not give you that information ? Is it that they can not trace the CCA? Now that they have sold it on, they do not want to have to repay the money received from this other company .

    Hello. If you send the DCA (who you have been paying) a request for CCA, and they say we have to contact the original creditor, are they acting illegally or just obstructively?. Moorcroft say we must contact RBS ourselves- surely this is wrong?

    Would someone comment?
