  • Has anyone here had any success going down the unforceable CCA route when you are up to date with payments etc and not being chased?

    I'm wondering if anyone has managed to get a creditor to accept a full and final settlement because they couldn't produce the CCA?

    All CCA requests apart from one (to capital one) were delivered today according to royal mail, so now just have to see what they turn up.
  • After looking carefully at the cca/application form that mbna have sent down I dont know how they ever set up an account for me in the first place or even was able to confirm my identity. my application form is not completed by myself as it was completed by some sales person at the ideal home exhibition. the mistakes are glaringly obvious my name is spelt wrong (however I never got a card down with the wrong name on it) my date of birth is wrong as well as my mothers maiden name which for some reason has my wifes name there and is nothing like my mothers maiden name. Just curious how they manage to get around these things. any further ideas on my cca I would be grateful although I think I have come to the conclusion that there is not a lot I can do about it.

  • Well totally unimpressed with Royal Mail, paid £4.60 which I couldnt really afford to make sure B/Card got my letter today, and it seems from the RM system it hasnt been delivered, it is still saying it is out for delivery, which seems a little unlikely me thinks.....Grrrrrr!!!!!!!! Cant phone them now until Friday either!

    At the beginning of December, I sent a CCA request to Intrum Justitia. Five days later, I received a reply as follows:

    "Thank you for your recent communication.

    Unfortunately, we are unable to provide you with the information that you requested and in light of the information contained in your letter, I can confirm that the above account has now been closed and that you will receive no further telephone calls or correspondance from Intrum Justitia in relation to this account.

    Please find enclosed the £1.00 fee you provided for the requested information"

    I have other CCA requests outstanding with Link, Connaught and Aktiv Kapital. All are in excess of 12+2. Watch this space..!

    By the way, whilst I know that the 12+2 time period are all working days, does this also apply to the following +30 day period?
  • Well I have found out why my letter to Barclaycard hasnt been delivered, its becuase the postcode I put on the envelope is wrong, and I copied it off one of their letters to me......:mad: Stupidly I didnt think I would need to double check something off one of their letters!!!!

    God knows when it will get delivered now and I cant afford another £4.60 to send another, so I have to hope the post office realise, which apparently the lady I spoke to on the phone thinks they may have done, am waiting for a call back from them now, but apparently it could be Monday before they get back to me :mad:
  • Just a quick question - one of our debts is with Cap1 and had been paid each month on agreement for over 3 years until sept when they passed to crapq. In early dec they sent dd form with increased amount - didnt reply. Then close to Xmas they sent letter from HL Legal rep Crapq rep Cap1 saying to reply with proposal by 27th dec.

    I sent them letter on 29th dec stating that did not want to get lost in xmas post ans that we have current agreement and enclosed regular payment as normal.

    Today a letter has come from Crapq dated 28th dec saying they feelthey need to go to litigation - most of the letter is crap, they have even offered to reduce debt by 50% which is a good £6k saving , saying we have to respond by 10th jan to prevent further action.

    All we want to do is pay this off each month, should we take the fact that we wrote to them on 29th Dec as having dealt with both letters?

    Have not requested CCA as been trying to get my head round it and if they go to court DH is not mentally well enough to deal.

    Any thoughts?
