It's up to Moorcroft to supply the CCA. I had a similar problem with them last year, wrote and pointed out their obligation under the CC Act and "politely" asked them not to be so obstructive. I never heard from them again.0

BC took over my Goldfish card, which used to be Morg Stanley. they were the only creditor out of 12 who were charging interest. I kept asking them to stop.....no reply, 3 times
I CCa requested.....no reply,
I 'default noticed' them after 45 days....no reply
Today, a reply from the Court Orders and Disclosures, Legal and Regulatory Compliance Dept ( 1234 Pavilion Drive, Northampton, NN4 7SG ). It contains a photocopy of a T & C leaflet for Barclaycard Accounts that were in operation at the time of my start of the Morgan Stanley Account, no Signature, obviuosly as I did not have a Barclaycard!!!
So this is 'a copy of the T&Cs that could have been in place should you have opened a Barclaycard at the time'!
Then the idiot who wrote the letter states...
...This completes our obligation to you under Section 78 of the CCA !!!
Do Barclaycard have their own, maybe pop-up ( or colouring in? ) version of the Act I wonder?:D stay wonky

I am also waiting for BC to comply with my requests Pepe, it doesnt seem like I should be holding my breath then. I wish my understanding of this was much better, but for sure what they have supplied is obviously not the right thing, I have found them nothing but trouble to deal with.....
I sent my last request special delivery, and was told by Royal Mail that becasue they are such a big company and have so many letters to sign for each day, it can take over a week for it to show up online....I think they are fobbing me off personally, and I may have to send it again to be sure, but I dont have £4.60 at the mo, and the man at Royal Mail assured me the delivery office manager for northampton categorically states he has no O/S letters for them....0 -
They would have got it, dont worry.
Quite often, when there are loads to one address a 'manifest' is signed detailing the individual Postal Item numbers rather than individually signing each one.
Recorded should be just £1.08......36p for 1st and 72p for recorded.
I had no acknowledgement for 2 months from BC. And when enquiring about delivery, you will prob get 'this item was out for Delivery on.....' and if then nothing is O/S it means that you can assume delivery.

I posted this on another thread, please could someone advise me where to go next - do I start again?
Back in November my husband received a letter from Lowell Portfolio covering debts to Capital One. He had a Visa card and a Mastercard. Both are in dispute over PPI and charges.
We sent the 1st letter - do not acknowledge the debt. Received letter from Lowell Portfolio advising it may take longer to get paperwork.
Sent 2nd letter, received acknowledgement of letter from Red Collection Services and one from Lowell Portfolio both advising that they had 42 days to get the papwerwork?
Then received what they say is a copy of the CAA - the Visa account was started in 2000. The form they have sent back with the Visa account number on is dated 2003 which is when the mastercard was taken out.
This morning we have now received a letter from Lowell Financial saying that they have now taken over the debt from Lowell Portfolio.
Please can someone tell me what to do next - I feel like banging my head against a wall!!0 -
Whoever has the debt HAS to provide the ORIGINAL Agreement. Signed by both he Account Holder and Themselves ( Creditor) it must be correctly worded, see other links.
42 is the absolute limit for providing it, 12 days for initial reqest, followed by a further 30 days. The account is then 'in dispute' and you should send the '30 day letter'.
Whoever holds the Account at thattime ( its a bit like pass the parcel ) is then not able to..
..enforce it in ANY way
..make ANYcharges
...pass it on to another collection agency
to do so is illegal.:D stay wonky

Sorry if I am having a daft moment.
Capital One had the original debt, the supposed CCA has been sent from Lowell but it is not the original CCA for the Visa Account. It is the application form for the Mastercard account.
Do I sent the 30 day letter to Lowell Portfolio Lowell Financial or Red Collections please.
Please someone point me in the direction of the correct links please0 -
Just read your post . Why on earth will they not give you that information ? Is it that they can not trace the CCA? Now that they have sold it on, they do not want to have to repay the money received from this other company .Barclaycard 3800

If you sent your original CCA request to Lowell Portfolio and the first 14 days ( 12+2 ) expired while it was with them, then they arre responsible for providing the CORRECT CCA.....from Capital One, signed by you and Cap 1.
If the 14 days expired while with them, then they should have notpassed it on! Any other DCA that had the Account before them can be ignored, its Capital 1 that counts.
Try the 'sticky' DFW Dictionary, most links are on there. If not, 'search' them...or someone will be along with one...they are all in this thread somewhere.............not a lot of use I know:D stay wonky
