If you want the money paid direct into your bank account, yes. Alternatively you can opt to have payment sent by cheque.

On September 26, 2008, the Court granted final approval of the Settlements. The Court also preliminarily approved Class Counsel's request for $23 million dollars in attorneys' fees and expenses, which is to be paid by British Airways and Virgin Atlantic separately and in addition to the refunds to Settlement Class Members. The Court will consider any objections to the attorneys' fees it has preliminarily approved that are submitted by October 17, 2008 before making a final award.

I think it's still awful that you have to submit a claim rather than getting an automatic refund. How many people won't claim so the airlines will keep their money? Between us OH and I flew with Virgin 6 times in the specified period so fingers crossed for something back.0

IMPORTANT UPDATE REGARDING DELAY IN THE TIMING OF REFUND PAYMENTS
On 21 October 2008, three Objectors appealed the Order and Final Judgment approving the Settlements. The Objectors argue that the District Court should not have exercised subject matter jurisdiction over UK Settlement Class Members whose claims are for travel to destinations other than the United States, and that the Court should not have certified the class. Resolution of this appeal is likely to take at least six months, and could take more than a year (or several years), depending on the speed with which the appeals court decides the issue. The appeals to the Settlements have been voluntarily dismissed by Order of the Court dated 1 April 2009.
The processing of payments for approved claims will now begin with first refund payments to be sent out in May 2009.

Just received a nice cheque in the post for £73.78, i know it's not loads of money but will go towards airport parking for this years hol. i think i claimed for 3 return flights to canada with ba, not sure if this includes hubbies as i claimed together or if he'll receive a separate cheque. I'm happy anyway, worth the effort!!0 -

got mine, Virgin 2 or 3 flights (cannot remember as was so long ago that we put in the claim!), £27.51.

Cheque received for £6.81 which was for a Virgin flight. Can't remember whether this was single or return.0
