Hmmmmm ..... yes, I see what you're saying Silvercar .. It's something I need to give careful consideration to .... Truth is, had she been reasonable in the begining and paid my back my deposit there would have been no question of further action for the non-compliance but as that isn't the case and she has been so horrid and bullyish then I suspect she should get everything that is due to her ... if you know what I mean ...:happylove Tori Bellatrix :happylove

Nothing legally stopping you telling her you will go to court (for 3x..) if your deposit isn't returned if full, then going to court regardless!I'm a Forum Ambassador on the housing, mortgages & student money saving boards. I'd go to court - count it as recompense for mental distress and the cost of phone calls (especially if you are on a dial up connection - MSE isn't coming cheap!). It will also show her that she has to act within the law. The terminally unpleasant should be dealt with likewise. Oh - and if you can, warn the new tenants that she's likely to vbe on the warpath so they should take a full set of pictures of everything on moving in, just in case they need to take similar action over alleged damage later.0

Right, the LBA is now written and will be sent tomorrow - I specifically asked for it to arrive Saturday so that she had the weekend to 'stew' before being able to speak to the solictor on Monday It's a bit wicked but nowt less then she deserves ...
She may of course simply dismiss it but it wouldn't be in her best interests. I have a feeling I might be in for some abuse when she gets it - so if she calls I don't think I'll answer my phone if she does ring or text.
I get so cross just thinking about what she has done .... I needed that money to repay my parents as they had lent me the deposit for the new flat - they've been really understanding about it so far. They even said they'd speak to her but I said it wouldn't do any good and they'd only lose their rag ... Mind you, they know how hard my sisters and I worked to get the place tip top so understandably they are p'd off with her ....:happylove Tori Bellatrix :happylove

well done TB - you have done the right thing - now just try to treat it as a professional dispute - otherwise it will eat away at you and make you miserable - continue to write calm, professional, accurate letters and statements and if in doubt - send "draft" copies of letters to mates before posting
in a similar circumstance - i used to send draft letters to a mate and he would - to use his own words = "remove the bile" before i put them in the post !!! thank goodness he did - else i would have sounded like a mad woman on occasion !!!0 -

DONT answer the phone , keep it STRICTLY professional from here on in....at the most text her advising so..
make a record of the date of every call , every letter etc etc

Just tell her that you would rather keep it all in writing to avoid any misunderstanding.RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

But make a note of any abusive visits or calls and keep any nasty texts - could come in useful in proving the landlady's 'unreasonableness' in court...0

Am also in deposit hell - landlord is dragging his feet about giving back our deposit (as he did about any tiem we asked him to fix anything in the flat during our tenancy
). He's still within the ten day rule, but having read these posts (and knowing what kind of person he is) I am definitely going to be on him with threats of 3 x deposit recompense after the ten days is over!!
