To threaten her, I would suggest writing to her explaining very carefully & politely that since she did not protect the deposit as she is legally required to do, she could a fine of £1950 if you take her to court, regardless of whether her claim on your deposit is justified. Give her seven days to return the deposit in full.

Hi, yes I'm still deciding if I should just be happy to try and get my deposit back or take her to the cleaners (which is an ironic statement considering she is saying the damage to her oven and hob was caused by negligent cleaning! :rolleyes:). I've decided to threaten her first and tell her that I want my deposit back and I'm also considering the 3x penalty regardless of whether she pays it back .. The LBA will be going out from a solicitor as I know she won't take any notice of me and to be honest, her attitide was so aggresive that I don't want to contact her personally. I also want her to know I'm not going to be messed about ...

No, she has moved back in herself ... or at least she was planning to but said that the small surface wear and tear on the oven and hob meant she couldn't move back in ... :rolleyes: .. It's ridiculous really as it's a cosmetic thing, barely noticable and exactly what you would expect to see on an oven and hob that has been used for 18 months ... Like many before you, I refer you to EagerLearner's thread. I can't see the point in paying a solicitor to write a LBA - plenty of examples provided in similar threads to this one.
Before you start your LBA I'd recommend getting all the necessary details for filing in the SCC. Although the LL is planning to return to the property, do you have their current address?0 -

I know I could write the LBA myself and I have seen some excellent examples but to be honest, right now, I don't want any contact with her - It isn't just about the money, she was downright rude, offensive and intimidating towards me. I'll only be using the sols for this and then any court action I'll do myself when I'm more cool headed about it and it's not so emotive.
I do have the LL previous address and I believe she will be moving back to the rental property fairly soon ... I've looked on Landlord zone and Consumer Action Groups and found some great threads for wording the forms. What would we do without all these great forums ... :T:happylove Tori Bellatrix :happylove

it is REALLY worth the read, honestly it is...... the girl grew and grew and grew in confidence during her battle with her witch of a LL while ELs honesty and integrity shone thru during the whole difficult time - she now runs a successful business of her own !!!0
