    You need to sting her for the full 3x penalty. If you don't she will get away with it and undertake the same thing in the future. Only be ensuring the rules are applied fully will she learn her lesson at all!

    Agree, don't give her the chance to give in, just take her for the full 3x.

    Don't even warn her about the 3x rule.
    Bankruptcy isn't the worst that can happen to you. The worst that can happen is your forced to live the rest of your life in abject poverty trying to repay the debts.

  • I'm a bit confused now .... On what basis should the LBA be sent then ... From advice, the non-compliance of DPS is higher priority then the unlawful deductions so the letter was going to be based around that and the fact that she had no right to keep it due to this .... If we mention the non-compliance, are you saying we shouldn't warn her that she can be fined as well?

    When a landlord deducts money from a deposit for damage to items in the property......it is not necessary for the landlord to actually use that money to replace the item. The payment is compensation for the damage and the landlord is free to spend the money wherever they wish.

    Landlords are NOT allowed to charge for their own labour.

    Recommendation:
    For all tenants who have money deducted from their deposit......make sure you write to the tax office. Tell them that your landlord has deducted money from your deposit and the landlord should account for it within their tax returns. Many don't.......and at the very least it will cause your landlord a little more grief.
