    ""at the very least it will cause your landlord a little more grief."" - if a LL has made a legitimate deduction from a deposit - why would you want to be spiteful and "cause more grief" ??

    I`m taking it as the OP recommending that course of action on the basis it wasnt legitimate ?

    Thats how i read it anyhow

    If the court rules in your favour and the deposit is returned to you the landlord is not receiving any of your money and so there is no need to contact the tax office.

    However, many tenants have sums deducted from their deposits which are somewhat questionable Those same tenants ether don't know about the Small Claims Court or can't be bothered for the sake of £50 or £100. Very often the landlord includes charges for their own labour and its only right that they should pay tax on this income like the rest of us.

    Of course, if the LL has made a legitimate deduction they will have informed HMRC, & therefore will not suffer any more grief. N'est-ce pas?;)

    Landlords are no different to everyone else where tax is concerned......guilty unless proved innocent.....at least in my book.:cool:

    Oh they have an anonymous phone line - me and my mates used to do it all the time to landlords - often not our landlords just friends' random amature BTLers landlords or people at work talking about their investment etc -
  • Hi, everone ... thanks for your comment .. I have tried to offically 'thank' you but my PC is sooooo slow (on Dial Up until my Broadband is moved across) and it doesn't seem to be working properly. ....

    Hopefully will get the letter sent today - In it I wish to point out that she has failed her statatory duty by failing to protect my deposit, that she has made unlawful deductions and that any 'damage' she says has been caused is 'wear and tear' ...
    Therefore I want the balance of my deposit returned in full ... the only but I'm confused about now is also to tell her that I will also be claiming for non-compliance .. :confused:

    The question is whether you would go to court to get 3 x your deposit if she repaid your deposit in full within the next 7 days.

    If the answer is that you would still go to court then I don't know the purpose of telling her.

    If you would be happy for a full deposit returned then tell her.
