They can say what they want about that, but they've got a bit of a problem due to the emails they sent out:

    1) The email is clearly marked as a "Receipt" so a contract has been established.

    2) It specifies the timing of when the order will be despatched.

As they have entered into a contract I'm expecting all those who got an order number and receipt to get this one.

I have 2 email confirmations, 1 for the original offer and 1 for the surprise gift.

Ive given up on receiving anything from them, they could have had loads of custom from me and my friends/family.

Good point Edna, Unfortunately I deleted the email receipt. This may sound harsh but I think companies like this shouldn't get away with not sending out freebies. If they are doing a promotion like that then they should moderate it and then stop the offer when they get too many requests. That's just my opinion.

Especially when this particular company decided to lap in up, act like they were genuinely excited and THEN go on to offer the chance of more freebies to those that missed out. They only have themselves to blame if they have been snowed under with work. Why didnt they just close it down and apologise?

I also had two email confirmations. They really should not have sent out the second saying we would receive a surprise gift and then not honour this.
Don't think I want any dealings with them now, was going to place an order but not anymore.

This is such a good company, having had dealings with them before, but they aren't huge. I think it's nice that they tried to honour as many freebies as possible. They aren't ICI, they could easily go down over something like this. Don't think we ought to be too mercenary or we're missing the point surely?

I disagree, especially when they have kept funds intended to cover the postage of a freebie. :naughty: If they arent sending them then they should refund the payments.
  • as they said, it was a promotion offered to cerain members on their mailing list....not openly available on their website.

It wasnt their fault that offer was posted on here by someone who receved that mailing...
  • I agree that it wasn't their fault that so many people took up the offer due to it being posted on other websites. but they should refund the postage people have paid. you pay the postage for the delivery of your items - no delivery should = no delivery charge.
Wins since June: iPod shuffle 1gb, Samsung g800, cinema ticket, lush retro giftbox, 2x mp3 downloads, a big box of food (???)
  • the statement on their site says they have not taken money from anyones cards...
  • Just a couple of further comments:

    1) Obviously it wasn't just this freebie site they were on, but every one going, so let's not kick ourselves too hard about it.

    2) Remember that they were gleefully sounding off on their website about how much traffic they were getting - something about a year's worth of visits in 2 weeks? How much would that brand PR have cost if it hadn't been free???

They probably got lots of orders too.

I have NO sympathy with anyone who sends me an order receipt and then doesn't deliver - it makes no difference whether they are a large plc or a small business. Whoever it is - no delivery - get Trading Standards to hammer them - end of story.
