    I think we are slowly losing the plot through all this, 'Restricted' you are perfectly correct with the statements you have made!

    I have been viewing these posts from the outside, I purchased one of these on Saturday and have received the letter this morning.
    We have two options we can either walk away and let them get away with a catalogue of events or we can fight, and by means of fighting , let them have some pain through this, as honestly speaking this is a huge mess which they will get out of very very lightly.

    List of events which I have seen, please comment.

    Product goes up for sale £357.11 & £20 delivery numerous sales, plus a few phone calls to the central customer services and local stores. Some of these sales were online and some of this sales were over the phone.

    Product gets taken off sale.

    Sunday morning product goes back up for sale, and even more sales go through.

    Money gets taken from everyones accounts.

    Monday no contact
    Tuesday no contact
    Wednesday reports of contact
    Thursday letters

    A regretable but obvious mistake they state, which I disagree with, as if it was this would have been taken off on Saturday, and customers informed on Saturday
    Was it another mistake that the stores agreed with the price and took some face to face orders
    Was it another mistake that they put it back online on Sunday!
    Was it another mistake they failed to contact anyone again
    Was it another mistake they accidently took all the money from the customers!

    JonathanJonathan, saw your post yesterday evening, and again if this is true this is wrong again, promising a delivery date/time and failing to show, and only commenting when you phone through!

    Excellent find this one as I will explain :-
    In order to have a reasonable case for complaint via court you would have to prove that it's not unusual for B&Q to offer similar deals with similar discounts etc. For instance last week they had MK switches etc prev selling at around £5.50 for £1 approx 80% discount for end of line or something ! I bought some too and still have receipts etc
    If you look at the Twenga link you can view the price history of the item and this shows that on the 30th of Jan the cost was a mere £1600 so it would not be unreasonable to assume that if the item is end of range or similar and expecting a discount of around 75/80 % which at 80% is £320 and 75% £400

    As I've said to all the newer members who are interested in taking legal action is go see a professional the trouble is everyone is posting different ideas but I think that no one is actually willing to go see a solicitor of even the citizens advice bureau any other comments really are not helpful unless you get proper legal advice.

    very good point silk, we did not know anything different at time of purchase, this could well have been an unbelieveable offer, never to be beaten!

    Spoken to Citizen advice, they have pushed me towards trading standards, as they stated, this is not just one mistake!

    And yes, I do want this garden office!

    Also Mr Showman, we are not posting different ideas, we all have a common goal which is the purchase of a Garden office, and yes I am and I am sure others are willing to go the extra mile, you have nothing in this world by just rolling over!
  • Showman, please look away now - this post contains the 'contract' word!

    If the contract has been breached, the normal measure for breach of contract is "loss of bargain".

    Just for the record, now that we know the correct price we can purchase the product at is £3579.10, if you were to claim under 'loss of bargain' it would be the difference between this and £357.11 (£3221.99)

    However, if they are now offering it to us at £3179 then they have cleverly reduced the claim to only £2821.89.

    I also just had another lengthy conversation with them and it seems that all is not dead. Will keep you posted, but what I can not quantify from this is how many people have been affected,

    I got my phone call this morning. Luckily I was out, so Lynn left a message on my answering machine.

    Also found my letter on the doorstep when I got back. I am, as The Broons might say, "black affronted" by the subtle dig at me in the sentence "As a result of the regrettable but obvious [my italics and bold] mistake....". How dare they! :shocked: 'Twasn't obvious to me!!!
